When informed that City Code restricts the number of main buildings to one <br />per lot of record, the Delaneys expressed a desire to not subdivide the property and apply for a <br />conditional use permit to accommodate their unique uses. At the same time, it was brought to the <br />attention of City Staff that the kennel operation, which is defined as a pre-existing non-conforming <br />use, has been expanding over the years, even as recent as 1989. The expansion of a non- <br />conforming use does require application for a conditional use permit, city Staff then determined <br />that it would be in the best interest of Charles and Loral I. to sanction the commercial kennel <br />operation on the site in conjunction with the conditional use permit to have more than one <br />residential structure on a lot of record. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cich to adopt the Findings of <br />Fact #0285 relating to Mr. Charles Delaney's request for a conditional use permit. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Cich, Pearson and <br />Peterson. Voting No: None. <br /> <br />Case #4: Request for Site Plan Approval; Case of Jim Charest, Egan Oil <br /> Company <br /> <br />Zoning Administrator Sylvia Frolik stated that Mr. Jim Charest, Egan Oil Company, is requesting <br />site plan approval to construct a 4,000 square foot cold storage warehouse on Lot 3, Block 2, HY- <br />10 Ramsey. The subject property is zoned I-1 Industrial for which warehousing is a permitted <br />use. The warehouse is proposed to be a concrete block structure used to store construction <br />materials. The proposed site plan discusses the fact that there would continue to be some exterior <br />storage use on the property that should be screened from Armstrong Boulevard N.W. and also that <br />a corrected drainage plan should be submitted to reflect that drainage will flow to a drainage area to <br />the rear of the property. <br /> <br />City Engineer, Steve Jankowski, stated that in his letter to Mr. Egan he informed him of the <br />screening requirements and the drainage plan. He suggested a 4' berm and then with trees planted <br />on the berm, it will meet the screening requirements. He stated Mr. Charest is agreeable. Mr. <br />Jankowski stated that the Planning and Zoning Commission is agreeable to Mr. Charest planting <br />seedlings. <br /> <br />Councilmember Pearson questioned why Mr. Charest's property is being singled out to be <br />screened if others don't have to be. <br /> <br />Mr. Jankowski answered that City Code requires that developments along streets should have <br />some type of screening. <br /> <br />Ms. Frolik stated the screening is required because of exterior storage. <br /> <br />Councilmember Cich inquired how the berm would assist the drainage. <br /> <br />Mr. Jankowski stated that the material for the berm would be taken from a low area which would <br />assist the drainage. <br /> <br />City Council/November 13, 1990 <br /> Page 9 of 16 <br /> <br /> <br />
