C: Resolution Recognizing the Anoka Senior High School Football Team <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Peterson to adopt Resolution <br />#90-12-384 recognizing the Anoka Senior High School Football Team for their outstanding <br />performance in the 1990 State AA Football Tournament. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Pearson, Peterson, Cich and <br />DeLuca. Voting No: None <br /> <br />D. Engineering Issue/Juniper Woods Addition Drainage Pond <br /> <br />Councilmember Peterson recalled the matter that took place earlier this year regarding the drainage <br />pond in Juniper Woods Addition. After meeting with the City Attorney and Hakanson Anderson <br />Associates, a settlement was reached. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich to accept payment <br />from Hakanson Anderson Associates, Inc. in the amount of $2,000.00 as a result of that drainage <br />pond change in Juniper Woods Addition. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, Cich, DeLuca and <br />Pearson. <br /> <br />E. Second Amended Employment Agreement/City Administrator <br /> <br />Attorney Goodrich reviewed the Second Amended Employment Agreement for the City <br />Administrator which puts into the contract those items from the resolution concerning his <br />resignation passed on December 11, 1990. Mr. Hartley's employment would terminate effective <br />December 31, 1990, with the employee to receive Severance Pay for three months' salary, 100 <br />percent of his accrued sick leave and accrued vacation through March 31, 1991, plus his health <br />insurance contribution and retirement plan contribution through March 31,1991, for a total dollar <br />amount of $31,650.04. Attorney Goodrich explained that the City's Personnel Policy provides <br />that one/third of any unused sick leave can be paid to the employee at the time of termination at his <br />current rate of pay. There is no exception to that except by City Council resolution and only after <br />adopting the Findings of Fact. Mr. Goodrich noted the resolution presented by the City <br />Administrator which was approved on December 11, 1990 constitutes the Findings of Fact which <br />proposed that Mr. Hartley is to be paid for 100 percent of the accrued sick leave. The City Code <br />also provides that an employee could be paid compensatory time, but this Agreement does not <br />provide for any compensatory time payment. Attorney Goodrich also pointed out the terms in the <br />Agreement that Mr. Hartley waives all other rights and/or benefits granted him in the original <br />Agreement, that he agrees to provide information and appear as witness for Ramsey in any State or <br />Federal court for the three months following termination, and that the Lump Sum Severance Pay is <br />to be paid on or before December 31, 1990. He recommended approving the Second Amended <br />Employment Agreement as revised and presented this evening, advising that the Findings of Fact <br />are in the resolution passed on December 11, 1991. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember DeLuca approving the <br />Second Amended Employment Agreement as revised. <br /> <br />Motion carried.
