Motion by Councilmember DeLuca and seconded by Councilmember Cich to hold another public <br />hearing either with the Council or the Planning and Zoning Commission. <br /> <br />Further discussion: James Neilson, Attorney representing Aluminum Recycling, Inc., saw no <br />reason to move the item back to the Planning and Zoning Commission. The application has <br />already been explained and the request has been diminished from the original, not expanded. He <br />didn't feel anything will be accomplished with another hearing. On the question of hours, that too <br />is being reduced from what was in the Findings of Fact. Only the furnace will be operating 24 <br />hours a day; the receiving portion of the business will be from 7:00 a.m. to 8:00 p.m., Monday <br />through Saturday. Councilmembers DeLuca and Cich felt another hearing is needed because of <br />some inconsistent facts and the need for the public to comment on the changed request. John <br />Heinen stated there were disagreements at the Planning and Zoning Commission meeting among <br />the Commissioners themselves, with one member leaving the meeting as the other members were <br />ignoring the Solid Waste Ordinance. He alleged the City Engineer's information kept changing to <br />make the facility acceptable for their recommendation. The vote was three yes, one no, three <br />absent, commenting the Council doesn't have much to stand on. Mr. Neilson stated he is prepared <br />to discuss the fact that Ordinance g90-5 does not apply. The Council generally noted again their <br />desire to hold another public hearing because of the changes since the initial hearing. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cich to amend the motion to <br />have the public hearing held by the City Council. <br /> <br />Discussion continued: Mr. Neilson stated the only inconsistency is the hours of operation, which <br />is an easy item to correct and are less than what the Planning and Zoning Commission approved. <br />Rebecca Leslie took exception to Items 45 through 53 in the findings of Fact. She stated this will <br />directly affect all of them, which is why they are here now. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich to amend the motion to <br />hold the public hearing on January 22, 1991 at 7:00 and at that point we would also review the site <br />plan which is to be updated. Glen Rychner stated he will look at the site plan and try to have it <br />ready for that meeting. There is clearly a lot of misinformation that has been passed out that he <br />hopes will be clarified. There was a brief discussion between Mr. Rychner and members of the <br />audience who objected to the proposal. Mayor Reimann explained all concerns will be addressed <br />at the January 22, 1991 public hearing. <br /> <br />Motion carried on amendment for January 22, 1991 public hearing. Voting Yes: Mayor Reimann, <br />Councilmembers DeLuca, Cich, Pearson and Peterson. Voting No: None. <br /> <br />Motion carried on amendment for public heating to be held by Council. Voting No: None. <br /> <br />Case #5: Agreement Granting Authorization to Waste Management of <br /> Minnesota, Inc. to Discharge Processed Groundwater into the City's <br /> Storm Sewer System <br /> <br />Attorney Goodrich summarized the proposal and agreement which was approved in concept by the <br />Council on December 11, 1999 for WMMI to discharge processed groundwater from around the <br />landfill through a forced system to the point just north of the Burlington Northern railroad tracks. <br />At that point it would connect to the City's gravity storm sewer system and continue to the <br />Mississippi River. WMMI proposes to construct an extension of the City's existing system from <br />its present location northward to across the railroad tracks, all done to the City's standards.
