MEMORANDUM <br /> <br />TO: <br /> <br />FROM: <br /> <br />Date: <br /> <br />SUBJECT: <br /> <br />Ken Wagner, Chairman of Economic Development Commission <br /> <br />Chris Thibodeau, Intern <br /> <br />June 22, 1990 <br /> <br />Zoning Enforcement <br /> <br />The queslion at the June 13, 1990 Economic Development Commission meeting was, <br />"What type of zoning enforcement will there be for all of the business and industrial <br />districts in Ramsey"? <br /> <br />I contacted the cities around Ramsey to find out what they did to enforce their zoning <br />regulations. <br /> <br />Andover stated that lhey use Conditional Use Permits due to the nature of the businesses. <br />If a business is in operation and does not have a Conditional Use Permit, the City will <br />verify that the business is in operation. Then a letter of violation of ordinance will be <br />sent to the business. The business wilt be required to go through the process of applying <br />for a Conditional Use Permit or to shut down. If the business is not in the proper zoned <br />area they will be required to shut down or to relocate. <br /> <br />Anoka stated that if a business was going to occupy a building that was used for a different <br />form of business, the new business was required to get an occupancy permit. If the <br />business had the same form of business as the previous occupant there was no need for an <br />occupancy permit. If a business locates in the industrial park area, they do need a <br />Conditional Use Permit. If a business moves in and does not let the city know, they have <br />to get the Conditional Use Permit even though it is after the fact. The business will have <br />to medicate the negative effects that it causes to the neighbors, in some cases, the <br />business will need to meet with the Planning Commission and City Council to come up <br />with an agreement in order for the business to receive a Conditional Use Permit. <br /> <br />Blaine stated that it would depend on the type of business whether or not it required a <br />Conditional Use Permit. If a business was in operation in an area that required a <br />Conditional Use Permit and they did not have one, one of two things will happen. They <br />would have to cease operations until receiving a Conditional Use Permit. They could get <br />an application in and start the process for a Conditional Use Permit. If the business is <br />not supposed to be there, the business will be ticketed. The business will be terminated <br />immediately and will be given a few days to leave the premises. Should the business <br />refuse to leave, legal actions will be taken. The business could also apply for rezoning. <br /> <br />Brooklyn Park stated that it would depend on the type of business whether it was <br />required by the City to issue a permit for the business to operate. Usually the <br />prospected businesses will call the City to find out what is and is not allowed to operate <br />in the various business and industrial districts before locating. The city does use <br />Conditional Use Permits. The City Council works with the businesses to make sure that <br />they are following the zoning regulations.
