businesses must meet the conditions of the resolution that was set up between the City <br />Council and the business. <br /> <br />Champlin stated that they do use Conditional Use Permits due to the nature of the <br />business. They keep a running list of all of the the businesses in the City. Usually the <br />businesses will contact the city before opening for business to find out what needs to be <br />done. <br /> <br />Coon Rapids stated that they do have Conditional Use Permits and it depends upon the type <br />of business and its zoning location. If a business opens up without a Conditional Use <br />Permit and did not notify the city, the city will send a letter to explain that they need a <br />Special Use Permit or a Conditional Use Permit. Depending on the situation, sometimes <br />the business will be asked to cease operation until some type of arrangements can be <br />made for a Conditional Use Permit to be issued. Sometimes the business is allowed to <br />continue until they receive their Conditional Use Permit. One way for the city to know <br />when a new business is opening is that the new business needs a sign permit if they wish <br />to put up a sign. <br /> <br />Dayton stated all of the businesses require a Conditional Use Permit. Should a business <br />move into an area and does not have a Conditional Use Permit, the business will first <br />have to apply for the Conditional Use Permit then there will be a public hearing with the <br />Planning Commission and the neighbors that are within 500 yards of the business. Then <br />it is brought before City Council for them to vote upon. If a business moves into an area <br />that it is not zoned for, the business will be shut down. <br /> <br />Elk River stated they do use Conditional Use Permits. The city relies on the business to <br />come in or call to check to see what type of permits they may need. Should a business <br />move in to a building without contacting the city and they are operating in a non- <br />conforming zone, they can be set up for a Conditional Use Permit. The city usually finds <br />out about the businesses that are located in a non-conditional area by either the <br />neighbors or the City Council members. Then the businesses have a couple of options. <br />There could be an ordinance amendment for the Conditional Use Permit or they could <br />apply for a zone change. Should they do nothing and stay in operation then the city can <br />red tape them and shut them down. <br /> <br />*The cities usually find out about the businesses that are operating in a non-conforming <br />zone by the neighbors, complaints, or the city council. Otherwise th.ere is no real way <br />for the city to know when a business is operating in the wrong zone. <br /> <br />PROPOSAL: All businesses would need a certificate of zoning compliance before they can <br />be in operation. All areas must be covered before they receive the certificate. <br />Examples: The business is located in the proper zoned area, fire inspections, electric <br />inspections, parking, etc... <br /> <br /> <br />
