Further Discussion: Mr. Goodrich noted that even with preliminary concept approval, the <br />City Council is still reserving the right to revise the entire PUD design depending on <br />Mn/DOT's review and recommendations regarding access onto Hwy. #47. Mayor <br />Reimann inquired if additional right-of-way is being acquired for future improvements to <br />Hwy. #47. Mark Banwart reported that additional right-of-way is being acquired for future <br />improvements to Hwy. #47. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />The City Council recessed at 8:30 p.m. <br /> <br />Mayor Reimann called the meeting back to order at 8:49 p.m. <br /> <br />Case #12: Consider Addition Of Nudity Ordinance: <br /> <br />Mr. Goodrich presented ordinances to regular nudity at licensed intoxicating and licensed <br />non-intoxicating liquor establishments. Mr. Goodrich reviewed minor technical changes <br />made to the ordinances since their introduction by City Council. Mr. Goodrich noted that <br />inclusion of a reference to MSA 617.246 does not affect the ability of a violation of same to <br />be prosecuted as a felony. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich to adopt <br />Ordinance #89-31, which is an ordinance regulating nudity in City licensed on-sale <br />intoxicating liquor establishments. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Cich to adopt <br />Ordinance #89-32, which is an ordinance regulating nudity in City licensed on-sale non- <br />intoxicating liquor establishments. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Mr. Goodrich then presented a proposed ordinance for introduction to regulate nudity in <br />non-liquor establishments, public or private. Mr. Goodrich noted that this type of <br />ordinance is more difficult to enforce from a constitutional standpoint. <br /> <br />Motion by Councihnember DeLuca and seconded by Councilmember Cich to introduce <br />Ordinance #89-X, which is an ordinance regulating nudity in non-liquor establishments. <br /> <br />Motion carried.
