(b) The MPCA has approved the Remedial Action Plan, <br /> the Metropolitan Council has extended the Certificate of <br /> Need and has granted all other approvals necessary for the <br /> Landfill so as to permit the Vertical Expansion, and all <br /> other governmental approvals necessary, including any such <br /> approvals by the County, have been obtained for the Vertical <br /> Expansion of the Landfill. <br /> <br /> (c) The City has granted all necessary approvals for <br /> the Project, there has been no subsequent action by the City <br /> with respect to'the Development Property which prevents or <br /> increases the costs of construction or' operation of the <br /> Improvements, and the City Council has not attached any <br /> additional conditions to the Conditional Use Permit and <br /> Environmental Permit or Site Plan except as set forth in <br /> this Agreement. <br /> (d) The City has not imposed any additional require- <br /> ments on the Development Property or the Project except (1) <br /> requirements contained in this Agreement, and (2) require- <br /> ments which are generally applicable to all landowners ih <br /> the City. <br /> Section 3.03.. Sit~ Preparation -- Obligation of the City. <br />Subject to the conditions contained in Section 3.04, the City <br />shall obtain the approvals required from all governmental'author- <br />ities to construct the road on the Road Right-of-Way Parcel. <br /> Section 3.04.
