~failed to perform its obligations when required pursuant to <br /> <br />Section 3.01 hereof. <br /> <br /> ARTICLE IV <br /> <br /> DEVELOPER'S CONSTRUCTION OBLIGATIONS <br /> <br /> Section 4.01. Subject to the conditions set forth in Sec- <br /> <br />tion 4.02, the Developer shall take the following actions: <br /> <br /> (a) Developer shall construct one tow rope which shall <br /> <br /> be at least 650 feet long on the Ski Hillo Plans and speci- <br /> fications therefor-shall be ~ in Developer's sole discre- <br /> tion. Subject to Unavoidable Delays, construction of the <br /> tow rope shall be completed by October 31, 1991. <br /> <br /> (b) Developer shall construct a warming house on the <br /> Recreational Parcel. The warming house shall have floor <br /> space of at least 1,000 square feet including rest room <br /> facilities. Plans and specifications therefor shall be in <br /> Developer's sole discretion. Subject to Unavoidable Delays, <br /> construction of the warming house shall be completed by <br /> October 31, 1991. <br /> <br /> (c) Developer shall Rough Grade the extension of 153rd <br /> Avenue on the Road Right-of-Way Parcel by October 31, 1991, <br /> subject to final approvals to be obtained by the City herein <br /> provided and subject also to Unavoidable Delays. The City <br /> Engineer and the Developer shall agree on the exact grade of <br /> the Rough Grading. <br /> <br /> (d) Developer shall convey to the City fee title to <br /> <br /> the Road Right-of-Way Parcel. All costs of constructing and <br /> <br /> <br />
