Pines subdivision. When Whispering Pines was developed in the early 1970's, drainage <br />easements were not taken, and ~n area of approxim~ly 20 ~res within this subdivision drains <br />into the lot owned by Mr. and Mrs. Bustrom located at 8341 - 154th Lane N.W. As a result, water <br />ponds in the Bustrom's back yard and an area immediately north of their proper9' in the North <br />Forty 3rd Addition subdivision. The Bustrom's have a finished walk-out basement and the)' have <br />reported water standing as close as ten feet of their home in the past. Mx. Jankowsk'i explained that <br />although the developer of North Forty 3rd Addition is not responsible for providing drainage <br />storage for the Whispering Pines subdivision, the approved drainage and grading plan called for <br />the construction of a 100 x 230 foot drainage retention pond enlarging the natural low area behind <br />the Bustrom's property. The dimensions of this proposed pond would provide several times the <br />pre-development ponding volume. He stated the developer did not address the complete pond as <br />proposed to be graded and although he has until June, 1991 to lake car~ of Phase I, which includes <br />grading, Mr. Jankowski feels it is extremely important to have the grading completed immediately. <br />His reasons are as follows: 1) The grading done to date has likely caused a net decrease in the <br />ponding volume available to store storm mn-off; 2) The developer had graded other ponding <br />areas in the subdivision and had an opportunity to construct this particular ponding area according <br />to plans; 3) The developer was notified in writing that the existing grading was not acceptable and <br />was given a reasonable amount of time (two weeks) to correct the grading; 4) That failure to grade <br />the ponds this fall will present a substantial risk of flooding of the Bustroms walk-out basement <br />during the critical melt period next spring; and 5) That to allow the developer additional time this <br />fall to correct the situation is no longer practical since impending frost conditions will make the <br />grading more expensive or impossible. Mr. Jankowski requested authorization to draw on the <br />North Forty 3rd Addition Es~'ow Account and hire Dresel Construction to complete the grading if <br />it has not been done by the end of this week. He has already spoken to Dresel Construction and <br />they will be able to do it upon request. <br /> <br />Motion by Councilmember Cich and seconded by Councilmcmber Petcrson to authorize Steve <br />Jankowski to contact Drescl Construction to do the grading immediately if it has not been taken <br />care of by the end of this week. The project will be funded with thc escrow account monies. <br /> <br />Motion carried. Voting Yes: Councilmember Cich, Peterson, DeLuca and Pearson. Voting No: <br />None. <br /> <br />Case #5: Receive Bids for River's Bend Park Handicapped Rails and Access <br /> Gate Improvement Project #90-29 <br /> <br />Mr. Jankowski stated that bid ads River's Bend Park Handicapped Rails and Access Gate <br />Improvement Project 4~90-29 were placed in the Anoka Union and Construction Bulletin and also <br />sent directly to all local metal workers listed in the area yellow pages to try to obtain local bids. <br />Two bids were received. The bid from DNCON, Inc. was for $25,577.50 and the Iow bid (even <br />lower than the En~neer's estimate) was from Selby Ornamental Iron Co. at $! 1,387.50. Mr. <br />Jankowski stated that Mr. Otto expressed his confidence in Selby Ornamental as he is familiar with <br />their work. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich accepting bids for <br />River's Bend Park Handrails and Access Gate and av.,arding a conu'act to Selby Ornamental Iron <br />Co. for such improvements contingent upon CDBG approval. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, Cich, DeLuca and <br />Pearson.
