CONSENT AGENDA Motion by Councitmember Pearson and seconded by Councilmember Pe[ersor: to approve tn: following items contained in the Consent Agenda: Approve license applications~ 2) Adopt resolution approving accounts payable transactions for the period Octobe'~ 15. 199(I through October 31, 1990 in the amount of $321,946.85. 3) Receive report of cash flows for period ending October 31, 1990. 4) Receive Landfill Tipping Fee and Expendable Trust Funds report. 5] Approve requem for a one year extension from October 3!, !990 to October 31, 1991 to complete site improvements at Mad Mac's Auto Sales, 6750 Riverdale Drive N.W. 6) Adopt resolution approving payment to Vincent G. Hicks and Michelle M. Hicks for damages resulting from the extension of I53rd Avenue N.W. 7) Receive letter from Anoka Count>, Commissioner Natalie Haas Steffen regarding the disposal of slag in the City of Ramsey and late night dumping at the landfill. 8) Approve change order no. 1 to Improvement Project #89-15. 9) Adopt resolution approving pay estimate no. 3 (final) to Aero Asphalt, Inc. in the amount of $5,447.14 for Improvement Projects ~P90-10 and itt90-12. 10) Adopt resolution approving pay estimate no. 6 (final) to Annandale Contracting, Inc. in the amount of $25,815.85 for Improvement Projects #87-27 and #89-t4. COUNCIL BUSINESS Case #1: Yard Waste Compost Facility CUP - Reconsider Term /,,@. Merland Otto, Hakanson Anderson stated that on October 23, 1990, the Ramsey City Council approved a conditional use permit for a yard waste compost facility for Waste Management of Minnesota. The term of the permit was set for 20 months with a performance review set for September, t991. Waste Management's legal counsel expressed concern with whether or not a new CUP could be issued at the end of the 20 month term since Ordinance ~.-<)0-5 would seem to prohibit that. The current CUP application was submitted prior to the adoption of Ordinance ~.~<90-5 and therefore, ',,,'as not subject to this ordinance. ~,C'-. Otto recalled that it was Ciu, Council's desire to have firm control regarding the term of the operation, however, it was not necessarily the intent of the Council to preclude the applicant from obtaining a new CUP if the operation performed sat/sfactofiiv. Waste Management of Minnesota is requesting Council to reconsider the te~-rn of the approved C'UP or an exemption to Ordinance ~.-<)0-5 for the purpose of avoiding a situation where the operation would be prohibited beyond the initial 20 months.
