1) <br /> <br />2) <br /> <br />3) <br /> <br /> PROPOSED FINDINGS OF FACT <br /> CONDITIONAL USE PERMIT <br />ANOKA COUNTY CENTRAL COMMUNICATIONS <br />EMERGENCY RADIO RECEIVER TOWER <br /> March 1, 1990 <br /> <br />That Bruce Wojack, representing Anoka County Central Communications Division, and <br />hereinafter referred to as "Applicant", has properly appied for a conditional use permit to <br />construct and maintain an emergency radio receiver tower facility in the Rural Business <br />District. <br /> <br />That the Applicant appeared before the Ramsey Planning and Zoning Commission for a <br />public hearing pursuant to Sections 170.016 and 170.013D of the Ramey City Code on <br />March 6, 1990 and that said public hearing was properly advertised and that the minutes of <br />said public hearing are hereby incorporated by reference. <br /> <br />That the subject property is generally known as <br />legally described as follows: <br /> <br />and is <br /> <br />4) <br /> <br />5) <br /> <br />6) <br /> <br />7) <br /> <br />8) <br /> <br />9) <br /> <br />10) <br /> <br />That the subject property is zoned Rural Business and is approximately .3 acres in size. <br /> <br />That according to Section 170.016 of the Ramsey City Code, radio receiver towers are not <br />a permitted use in the Rural Business District, or in any other district, but may be permitted <br />upon obtaining a conditional use permit. <br /> <br />That the property to the west of the subject parcel is zoned Rural Business and the <br />properties to the north, south and east are zoned R-1 Rural Residential. <br /> <br />That on February 26, 1990, the City received an application from Anoka County Central <br />Communications Division for a conditional use permit to construct and maintain an <br />emergency radio receiver tower in the Rural Business District. <br /> <br />That the Applicant has stated that a receiver tower is necessary in the subject area to <br />alleviate problems encountered by Ramsey Police and Fire Departments attempting to <br />receive transmissions from Central Communications. <br /> <br />That the Applicant has stated that the proposed facility will be used to improve the <br />capability to receive radio transmissions in the area and will not be used as a radio <br />transminer facility. <br /> <br />That the proposed facility will consist of a utility pole approximately 50 (fifty) feet in height <br />on which an antenna will be mounted; an antenna approximately 5 (five) feet in height; an <br />81 (eighty-one) square foot equipment shelter structure; and surrounded by a 6 (six) foot <br />fence for safety and security purposes. <br /> <br />That there is a similar permitted use in the City approximately 2.25 miles from the subject <br />site and a similar pre-existing non-conforming use approximately 5.5 miles from the <br />subject site. <br /> <br />That the proposed use will not be dangerous or detrimental to persons residing or worldng <br />in the area. <br /> <br /> <br />
