Management Ordinance also states that <br />elevation to the Regulatory Flood Protection Elevation shall be provided where <br />failure or interruption of these transportation facilities would result in danger to the <br />public health or safety or where such facilities are essential to the orderly <br />functioning of the area. <br /> <br />That Section I70.069.23 states that all necessary State and Federal permits must be <br />obtained by the applicant prior to the granting of the conditional use permit. <br /> <br />That Anoka County has obtained the necessary permits from the Department of <br />Natural Resources and the Army Corp of Engineers relating to the improvement of ': <br />County Road #83. <br /> <br />That in the past, the City has approved requests for conditional use permits to <br />excavate materials. <br /> <br />That thc proposed cxcavation operation will temporarily increase traffic in thc area. <br /> <br />That the applicant has stated that the anticipated duration of the proposed excavating <br />operation is approximately months. <br /> <br />That the applicant has stated that the proposed excavation will generate a maximum <br />of~ tracks hauling materials daily. <br /> <br />That the proposed excavation operation will not permanently adversely impair the <br />enjoyment or use of surrounding properties. <br /> <br />That access to the subject property will be from County Road #83. <br /> <br />That the traffic generated by the proposed excavation operation will be temporarily <br />disturbing to adjacent properties. <br /> <br />That the proposed extraction operation will be adequately served by essential public <br />facilities such as County Road #83. <br /> <br />That the proposed extraction operation will not create excessive additional <br />requirements at public cost for public facilities. <br /> <br />That the odor caused by the extraction and stockpiling of muck material may be <br />temporarily disturbing to adjacent properties. <br /> <br />That the conditional use permit requested is accessory to a substantial transportation <br />improvement that will benefit the immediate vicinity and the community as a whole. <br /> <br /> <br />
