Councilmcmbcr moved the adoption of the following findings of fact: PROPOSED FINDINGS OF FACT CONDITIONAL USE PERMIT FOR A HOME OCCUPATION 14151 GERMANIUM STREET N.W. PIN 25-32-25-33-0006 OCTOBER 29, 1990 That Steven Haigh, hereinafter referred to as "Applicant", has properly applied for a conditional use permit for a home occupation to operate a retail u-ophy/plaque shop in a private dwelling located in the R-1 Urban Residential District. That the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Sections 170.0151 (Home Occupations) and 170.013D (Conditional Use Permits) on November 7, 1990 and that said public hearing was properly advertised and minutes of that public hearing are hereby incorporated by reference. The subject property is generally known as 14151 Germanium Street N.W. and is legally described as follows: Lot 4, Block 2, Flintwood Hills, Anoka County, Minnesota 4. The subject property is approximately one (1) acre in size. 5. That the adjacent properties are also zoned R-1 Urban Residential. 6. That retail sales is not a permitted use in the R-1 Urban Residential District. o That Section 170.0151 of the Ramsey City Code regarding home occupations states that the operation of any wholesale or retail business, unless it is conducted entirely by mail and does not involve the sale, shipment or delivery of merchandise on the premises, is prohibited; and merchandise shall not be displayed or offered for sale either within or outside of the residence. o That the Applicant has stated that the proposed home occupation will consist of a retail operation which will include the sale, shipment or delivery of merchandise on the premises and displaying merchandise offered for sale. o That City Code Section 170.015I regarding home occupations states that the use shall not be conducted in more than one room of the private dwelling and shall not exceed 20% of the total floor area of the residence. 10. That the total floor area for the dwelling on the subject property is 2,556 square feet; the proposed home occupation will be conducted in one room approximately 288 square feet in size which is less than 20% of the total floor area. 10. That the Applicant has stated that in accordance with Section 170.0151 regarding home occupations, there will be no employment of persons not residing on the premises in the performance of the occupation. 11. That there are currently no other similar permitted uses in the City and since 1981, the Ramsey City Council has denied 5 similar requests for home occupations involving retail activity.
