Councilmcmbcr <br /> <br />moved the adoption of the following findings of fact: <br /> <br /> PROPOSED FINDINGS OF FACT <br />CONDITIONAL USE PERMIT FOR A HOME OCCUPATION <br /> 14151 GERMANIUM STREET N.W. <br /> PIN 25-32-25-33-0006 <br /> OCTOBER 29, 1990 <br /> <br />That Steven Haigh, hereinafter referred to as "Applicant", has properly applied for a <br />conditional use permit for a home occupation to operate a retail u-ophy/plaque shop in a <br />private dwelling located in the R-1 Urban Residential District. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Sections 170.0151 (Home Occupations) and 170.013D (Conditional <br />Use Permits) on November 7, 1990 and that said public hearing was properly advertised <br />and minutes of that public hearing are hereby incorporated by reference. <br /> <br />The subject property is generally known as 14151 Germanium Street N.W. and is legally <br />described as follows: <br /> <br />Lot 4, Block 2, Flintwood Hills, Anoka County, Minnesota <br /> <br />4. The subject property is approximately one (1) acre in size. <br /> <br />5. That the adjacent properties are also zoned R-1 Urban Residential. <br /> <br />6. That retail sales is not a permitted use in the R-1 Urban Residential District. <br /> <br />o <br /> <br />That Section 170.0151 of the Ramsey City Code regarding home occupations states that the <br />operation of any wholesale or retail business, unless it is conducted entirely by mail and <br />does not involve the sale, shipment or delivery of merchandise on the premises, is <br />prohibited; and merchandise shall not be displayed or offered for sale either within or <br />outside of the residence. <br /> <br />o <br /> <br />That the Applicant has stated that the proposed home occupation will consist of a retail <br />operation which will include the sale, shipment or delivery of merchandise on the premises <br />and displaying merchandise offered for sale. <br /> <br />o <br /> <br />That City Code Section 170.015I regarding home occupations states that the use shall not <br />be conducted in more than one room of the private dwelling and shall not exceed 20% of <br />the total floor area of the residence. <br /> <br />10. <br /> <br />That the total floor area for the dwelling on the subject property is 2,556 square feet; the <br />proposed home occupation will be conducted in one room approximately 288 square feet in <br />size which is less than 20% of the total floor area. <br /> <br />10. <br /> <br />That the Applicant has stated that in accordance with Section 170.0151 regarding home <br />occupations, there will be no employment of persons not residing on the premises in the <br />performance of the occupation. <br /> <br />11. <br /> <br />That there are currently no other similar permitted uses in the City and since 1981, the <br />Ramsey City Council has denied 5 similar requests for home occupations involving retail <br />activity. <br /> <br /> <br />
