within 48 hours and stated that in terms of the tonnage being addressed, it would be impossible to <br />move all of the compost material from the site, especially if there is one small area creating the odor <br />problem. Mr. Miller stated that he is requesting that the requirement of the conditional use permit <br />be amended to require that odor problems will be addressed within 48 hours and that the <br />requirement to remove all compost material be eliminated. Commissioner Terry inquired as to who <br />will be responsible for verifying and determining legitamacy of an odor complaint. Commissioner <br />Hendriksen stated that it would be incumbent upon the City to verify odor problems. Mr. Otto <br />noted that in WMMrs application from January, 1990, they applied for a site for 23,200 tons of <br />yard waste. The City's interpretation of that was that it was inclusive of windrows and curing <br />piles. The intent of WMMI was that their application referred to 23,200 tons of yard waste <br />received annually. That 23,200 tons received is left in windrows for one year. This site would <br />also then have a product in curing piles and in total theoretically, the site could have 46,000 tons of <br />yard waste on site. <br /> <br />Mr. Otto stated that WMMI is also concerned with the requirement that all working areas be <br />surfaced with Class V or wood chips. That requirement will most likely be amended to require that <br />all equipment manuevering areas are surfaced with Class V or wood chips. Mr. Otto noted that <br />Item #17 of the proposed conditional use permit proposed to limit the facility to 23,200 tons <br />annually, inclusive of all materials in various stages. Mr. Otto stated that Item #22 of the proposed <br />conditional use permit should be amended to require weekly monitoring April 1 through October <br />31 to assure moisture, oxygen, temperature and Ph levels that would facilitate optimum <br />decomposition and minimize odors. Mr. Otto stated that Item #23 of the proposed conditional use <br />permit should indicate that WMMI shall maintain optimum levels of oxygen, moisture and <br />temperature to facilitate optimum decomposition. Item #23 should also be amended to indicate that <br />a windrow machine shall be used to rotate the composting material, but not to require the use of a <br />windrow machine on a weekly basis. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Deemer to amend Item #23 of <br />the proposed conditional use permit to replace the phrase "rapid decomposition" with "optimum <br />decomposition". <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Bawden, Deemer, <br />Hendriksen, LaDue, Terry and Thorud. Voting No: None. <br /> <br />Mr. Miller indicated that WMMt will purchase a windrow machine when it becomes necessary. <br />Mr. Otto stated that he spoke with the Anoka County yard waste site manager at Bunker Hills and <br />he was adamant that the only way to reasonably expect to take care of odors is with a windrow <br />machine. Further research also bears this out. Mr. Miller referred to the proposal to limit the site <br />to 23,000 tons inclusive of all processing. Mr. Miller stated that the intent of the yard waste end- <br />product is to fulfill obligations in closing the landfill site. If the yard waste facility is limited to <br />23,000 tons and if WMMI needs 45,000 cubic yards of topsoil, then they would be before the <br />Commission requesting a variance to store more than 23,000 tons of yard waste material. Mr. Otto <br />stated that what WMMI is requesting is four times the size of the Anoka County yard waste <br />facility. Mr. Otto did note that when the yard waste compost is in its finished product, it is not <br />necessarily odor generating at that point. Mr. Miller noted that WMMI has been landspreading <br />yard waste since April of 1990 and has received only one complaint and that was immediately <br />addressed. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Deemer to amend the proposed <br />conditional use permit to require only the surfacing of equipment maneuvering area with Class V or <br />wood chips. <br /> <br />Planning and Zoning Commission/September 4, 1990 <br /> Page 12 of 14 <br /> <br /> <br />
