taken at a later date so that the assessment would be based on the estimate. Following that time if <br />the project is ordered, plans would be prepared and bids received and construction begins. There <br />will be no construction until 1991. Mr. Hartley noted that the residents may also petition to have <br />the road improved to Class V standards instead of pavement. Mr. Hartley stated that even if the <br />road is brought to Class V standard only, the road would be realigned to its legal position. Mr. <br />Hartley noted that if in the next 60 days, a petition is received from 51% of the property owners in <br />favor of the project, the project can be ordered. If a petition is received from 51% of the property <br />owners not in favor of the project, the project cannot be considered again as it is defined this <br />evening for a period of one year. In addition, the property owners can petition for a different <br />project. <br /> <br />Larry Sanders, 17135 Bison Street N.W. - stated that Dellwood Hills was approved contingent <br />upon roads being upgraded and improved. If Bison Street N.W. is not improved, what will be the <br />effect on Deltwood Hills? <br /> <br />Mr. Raatikka replied that Dellwood Hills is only obligated to provide improved roads up to Bison <br />Street N.W. <br /> <br />Larry Sanders replied that Dellwood Hills approval was contingent upon Bison Street N.W. being <br />upgraded. <br /> <br />Mr. Goodrich replied that the developer of Dellwood Hills deposited an amount of funds with the <br />City to pay for his share of Bison Street N.W. when it is improved. The developer of Bison Street <br />N.W. cannot build homes in that development until t71st is upgraded but he can build homes <br />without Bison Street N.W. being upgraded. <br /> <br />ADJOURNMENT <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember DeLuca to adjourn the <br />public hearing. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, DeLuca, Cich and <br />Pearson.
