If it is not possible to control the dust on any given day, the extraction operation shall cease on that day. If, in the opinion of the City Engineer, the dust created by the operation is excessive, the operation shall cease until the dust problem is abated. In order to prevent excessive dust pollution, the excavation operation shall discontinue at an), time when wind gusts are in excess of 30 miles per hour. All equipment used for grading, mining or filling operations shall be maintained and operated in such a manner as to minimize, as far as practicable, noises, dust and vibrations adversely affecting surrounding properties. A performance bond in the amount of $7,500.00 per five acres of property to be excavated shall be filed with the City to cover any screening, buffer and turf establishment costs incurred by the City in the restoration plan. This bond shall be kept current until the grading and excavation operation is finally completed. Mr. Bridwell shall be responsible for ail expenses incurred in the administration of this conditional use permit and shall maintain a minimum of $500.00 in the CUP escrow account to assure same. Mr. Bridwell shall provide to the City a liability insurance policy or certificate of such insurance acceptable to the City and issued by an insurance company authorized to do business in the State of Minnesota. The policy shall insure the person performing acts described herein for the sum of at least three hundred thousand dollars for injury to one person, and five hundred thousand dollars for one accident and at least one hundred thousand dollars for property damage. Said policy shall be for the full period of the permit and shall provide for the giving of ten days prior notice to the City Administrator by reFstered mail or termination, cancellation, or amendment of the policy. c.
