On a 3-2 vote, <br />P&Z adopted findings of fact and recommended approval of the CUP. <br />During review of the CUP conditions, they voted to table the case <br />until their December 6 special meeting pending an opinion by you <br />and your review of the CUP. <br /> <br />In particular, P&Z desires your opinion as to whether the proposed <br />aluminum processing and recycling facility is a solid waste <br />management facility under the definition of Ordinance 90-5. <br />Secondly, they desire any comments you might have on the proposed <br />conditions. <br /> <br />The 3-2 position of P&Z is that a recycling center is not a solid <br />waste management facility and therefore is not subject to Ordinance <br />90-5. I am enclosing excerpts of various MC articles, KAB <br />materials and the Solid Waste Act which would seem to indicate that <br />recycling and reuse is one method of managing solid waste. <br /> <br />You have previously received the P&Z case. Sylvia should have the <br />minutes of the public hearing.
