PROPOSED FINDINGS OF FACT CONDITIONAL. USE PERMIT RHO~DA WILLIAMS AND PHILIP SWIGGUM 17450 BAUGH STREET N.W. 1) That ~honda Williams and Philip Swiggum, herein&fret referred to a~ "Applicants", have properly applied for a conditional use oermit to maintain a hobby horse farm to accommodate a maximum of five (5) horses at any one time. ~) That the Applicants appeared before the Planning and Zoning Commission for a public hearing pursuant to Section 170.013D of the City Code on on December 6, 1988 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by referer, ce. That the subject property ie generally known as 17450 Baugh Street N.W. and is legally described as follows: The east 439 feet of the north 200 feet of the south 1233 feet of the southeast quarter of the southwest quarter of Section 6, Township 32, Range 25 in Anoka County, Minnesota, said distances being measured parallel with the east and south lines of the southwest quarter of said Section 6 (subject to an easement for road purposes over the east 33 feet thereof). -and- The north 200 feet of the south 1233 feet of the west 439 feet of the east 878 feet of the southeast quarter of the southwest quarter of Section 6, Township 32, Range 25, in Anoka County, Minnesota, as measured along the south and east lines of said southeast quarter of the southwest quarter. 4) That the two subject parcels are continguous and total approximately 4.2 acres in size. 5) That the subject property is located in the R-iR Residential District. That Section 110.07 of the City Code requiring that there be at least three acres for each horse maintained on a parcel has been in effect since 1978. 7) That Section 170.016A of the City Code requiring that all accessory buildings housing animals be at least 75 feet from neighboring property lines became effective with recodification in 1986; the barn on the subject property was in existence prior to that time. That the adjoining properties are zoned R-iR Residential and are occupied by residential structures. 9) That the Applicants have stated that horses have been maintained on the property since it was developed in 197!. 10) That uhe Applicants have stated that there are approximately eight other horse hobby fa~s in the neighborhood.
