City and specifically submitted pursuant to the planned unit <br />development section of said Code, and is the subject of a <br />previous written planned unit development plan on file and of <br />record with the City, which PUD has received concept approval by <br />the City Council of the City. The parties further acknowledge <br />that the plat of NORT~FORK SECOND contains 22 single family <br />residential lots. <br /> <br /> 2. ~. Public improvements to be incorporated <br />and constructed in conjunction with the plat of NORT~FORK SECOND <br />include that portion of Andrie Street included in the plat and <br />drainage easements as shown on the Developer's drainage plan <br />attached hereto as Exhibit "B" and the Developer's street plan <br />attached hereto as Exhibit "C". The Developer shall be <br />responsible for the expenses associated with the construction of <br />these improvements. The respective locations of Andrie Street <br />and the drainage easements shall be as shown on the attached plat <br />drawing of NORTI~FORK SECOND, which plat is attached hereto as <br />E~l~ibi t ~D". <br /> <br /> a. CONSTRUCTION BY DEVELOPER. The Developer shall <br />guarantee that the construction of Andrie Street together with <br />all necessary ditches, backsloping, drainage and appurtenant <br />improvements shall be in accordance with the standards of the <br />City and the Developer's plans as shown on attached Exhibits "B" <br />and 'C", and as required in the City Code, and as recommended by <br />the City Engineer.
