Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-10-283 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0656 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT TO CONSTRUCT A SCHOOL <br />LOCATED IN THE TOWN CENTER 3A SUBDISTRICT <br /> <br /> WHEREAS, Academic Investments, Inc., hereinafter referred to as the "Applicant," has <br />properly applied for a Conditional Use Permit to locate a school in the Town Center 3a Zoning <br />District property legally described as follows: <br /> <br />Lot 1, Block 1, Town Center Addition, Anoka County, Minnesota once the plat is <br />recorded. <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Ramsey City Code on October 2, 2003, and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated by reference. <br /> <br />2. That the Applicant has submitted a site plan to construct a two-story, 71,350 square-foot <br /> Charter School on Lot 1, Block 1 of the proposed Town Center subdivision. <br /> <br />3. That the Subject Property is approximately 5.35 acres in size. <br /> <br />4. That the Ramsey City Council adopted the Town Center Zoning District on September 23, <br /> 2003. <br /> <br />5. That the Subject Property is zoned TC-3a and is located inside the urban service area. <br /> (MUSA). <br /> <br />6. That the TC3-a subdistrict states that schools are only permitted as a conditional use within <br /> the District. <br /> <br />7. That the City is in the process reviewing Town Center Development Guidelines that have <br /> specific standards for development within the Ramsey Town Center. <br /> <br />8. That the Town Center Development Guidelines are intended to provide a flexible framework <br /> that assists in the review of developments within the Town Center. <br /> <br />9. That the Town Center Development Guidelines for the TC-3 subdistrict were drafted for <br /> commercial/office uses. <br /> <br /> <br />
