2003, the City Council approved the site plan subject to the applicant receiving a Conditional <br />Use Permit in accordance with the Ramsey Town Center Zoning District Guidelines. <br /> <br />Assistant Community Development Director Trudgeon indicated the Planning Commission <br />directed staff to create a TC-3a district where schools would be conditionally allowed and that <br />had slightly different standards in regards to the F.A.R. and 'build to' requirements. Staff <br />brought forward these changes to the City Council on September 23, 2003. He stated at that <br />meeting, the City Council adopted the Town Center Zoning District which included the TC-3a <br />SubDistrict, therefore the approved site plan meets the new requirements for the TC-3a <br />subdistrict. <br /> <br />Assistant Community Development Director Trudgeon advised that in the Planning Commission <br />site plan review, it was brought forward by Staff that there were a few areas where the site plan <br />did not meet all of the proposed Town Center Draft Development Guidelines. It is the intent of <br />this CUP to allow for these deviations from the Guidelines based on findings to be adopted by <br />the City. He noted that after responding to initial Staff and Planning Commission comments, the <br />site plan now substantially complies with the Guidelines. <br /> <br />Assistant Community Development Director Trudgeon advised Staff recommends granting the <br />request for conditional use permit based on supporting findings of fact. He noted this is a <br />positive step and sets the standard if others want to deviate from the design guidelines. <br /> <br />Public Input <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt to close the public hearing at <br />9:23 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Shepherd, Van <br />Scoy and Watson. Voting No: None. Absent: None. <br /> <br />Commission Input <br />Chairperson Nixt asked where they were at on the Developer's Agreement. <br /> <br />Assistant Community Development Director Trudgeon indicated the City Council entered into <br />the Developer's Agreement on September 16, 2003, and approved final plat on September 23, <br />2003. <br /> <br />Chairperson Nixt asked if recognizing obligations and timelines, both sides are in a position to <br />perform. <br /> <br />Assistant Community Development Director Trudgeon stated they are. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Van Scoy, to recommend that <br />City Council adopt findings of fact relating to Academic Investments site plan for the PACT <br />Charter School for a conditional use permit to deviate from certain elements of the Town Center <br />Development Guidelines. <br /> <br />Planning Commission/October 2, 2003 <br /> Page 15 of 17 <br /> <br /> <br />
