Further, that the conditional use permit be amended as follows: Item ~.3- Change to read: after site plan review.' 'That no development shall take place until Item ~,4 - Change to read: 'That the conditional use permit is contingent upon the applicant entering into a mutually agreeable development agreement. ' Further Discussion: Ms. Norris inquired as to the Commission's direction regarding a time frame for construction of the advertising sign. Commission consensus was that the advertising sign shall be addressed as part of the site plan. Motion carried. Voting Yes: Terry, Hendriksen and InDue. Holm and Howell. Absent: Commissioners ~ Regu_ est For Preliminary Plat Approval Of Juniper Woods: Case Of Mr. Dick Knutson: Chairman Zimmerman stated that Albin Peterson has expressed concern for the maintenance of a previous agreement with the City stating that the extension of sewer and water is intended to serve his property and River's Bend. City Engineer Raatikka stated that there was an agreement drawn up in 1984 when River's Bend was platted. The City Attorney has reviewed that agreement and it states that the services are intended to serve, but not solely, the D~lbin Peterson property. F~tion by Commissioner Hendriksen and seconded by Commission'~er Shumway to table preliminary plat approval of Juniper Woods until such time as the ~tro Council has made a determination regarding the expansion of P~msey's 1990 Urban Area and a determination has been made re<3arding allocation of that additional sewer capacity, if it is granted. Further Discussion: Ms. Norris stated that a decision has be'eh made regarding which _marcels would receive the additional sewer capacity; Ramsey's proposal to M~tro Council specified the areas to be served by the additional capacity gained. Commissioner Hendriksen inquired as to who makes the decision reg.~arding which parcels will be_ allocated the additio~ ~ng! capacity.
