ACRES OF COUNWRY PRIVAC~Y 1

April 6, 1989

City Coucilmen
Planning and Zoning Commissioners
Park and Recreation Commissioners
c/o Mr. Merland Otto
Hakanson, Anderson Engineering
222 Monroe Street
Anoka, Mn. 55303

Re: Park Dedication Agreement

Dear Councilmen and Commissioners:

Please find enclosed a copy of a proposed ADDENDUM to the existig
Park Dedication Agreement covering the Northfork PUD. The ADDENDUM
is North Fork's proposal for a comprehensive agreement governing park
dedication for the entire PUD. As most of you are aware representatives
from the Planning and Zoning Commission, Park and Recreation Commission,
City staff, Northfork Homeowners Association and North Fork, Inc. met
to discuss proposed land park dedication for the area of the Northfork
PUD generally south of 153rd Avenue NW. These representatives reached
a tentative agreement. The map referenced in the enclosed ADDENDUM
was prepared by Hakanson, Anderson and, we believe, accurately
represents the agreement reached by those representatives. That
agreement, as far as it went, is included in the prosposed ADDENDUM.

However, subsequent discussion with City staff evidenced a
substantial disagreement between staff and North Fork regarding cash
park donation for those certain lots lying west of Andrie Street and
north of i53rd Avenue NW. North Fork opposed the procedure established
by staff in making the determination of the fair market value of the
undeveloped land. North Fork also never intended to forego the right
to argue as a credit or offset against cash donation, the establishment
of an open to the public golf course in the PUD and the private
recreation amenities and open space established by the Northfork
Homeowners Association or North Fork.

It was determined, therefore, at the last meeting, that in an
effort to resolve these issues, North Fork prepare a proposal stating
its position and ~o submit this proposal to the approriate Commissions
for review. Paragraphs 7, 8, 9 and 16 of the ADDENDUM contains North
Fork's position on the unresolved matters.

Developed by North Fork, Inc.

713 Bradford Ave. No., Champlin, MN 55316 · 421-7147 · Sales - 429-8281

too
