City Councilmen <br />April 6, 1989 <br />Page Two <br /> <br /> The attached ADDENDUM indicates North Fork's position that little, <br />if any, additional cash park dedication be required for the lots located <br />west of Andrie Street and north of 153rd Avenue NW and covered by <br />Paragraph 5 of the original Park Dedication Agreement. In support of <br />this position North Fork would cite the following facts: <br /> <br />The Northfork PUD consists of approximately 1250 acres <br />on which there are approvals to build 250 homes, thus <br />creating a density of .25 units per acre. The anticipated <br />population of the Northfork PUD, when completed, should <br />be approximately 1000 people. <br /> <br />o <br /> <br />Under the current City Code the City can claim up to 10% of <br />the land being platted for park dedication purposes or 10% <br />of the fair market value of the undeveloped land as cash <br />alternative. Presumably under the proposed new Park Dedication <br />Ordinance this figure would be reduced to 7%. <br /> <br />The first phase of the Northfork PUD consists of approximately <br />125 acres for which cash payments for park dedication have <br />been and are continuing to be made. <br /> <br />Of the remaining 1125 acres of the Northfork PUD 550 acres are <br />already being set aside for private and/or public recreational <br />use in the form of a proposed open to the public golf course <br />(160 acres), private open space to be dedicated to the <br />Northfork Homeowners Association (250 acres), the open waters <br />of Lake Itasca and Northfork Lake and the surrcunding shorelines <br />to be dedicated to theNorthfork Homeowners Association ~150 <br />acres). <br /> <br />North Fork, pursuant to the Declarations governing the entire <br />PUD, pays to the Northfork Homeowners Association, out of the <br />proceeds of the sale of each lot $250 to be used ~o-d~velop <br />private amenities in the PUD. <br /> <br />The City has received or will receive approximately 55 acres <br />of park and trail under the terms of the existing Park <br />Dedication Agreement and the proposed ADDENDUM, plus two <br />acres for tot lots. This 57 acres represents 10% of all the <br />land in the Northfork PUD not already being proposed for public <br />and/or private use or included in the first phase. (See items <br />3 and 4 above). <br /> <br />Contributions by the Northfork Homeowners Association and <br />North Fork for the develomen% of amenities in the PUD reduces <br />the City's obligation in such regard. <br /> <br />Chapter 170.061 of the proposed new Park Dedication Ordinance <br />states in part: <br /> <br /> <br />
