City Councilmen April 6, 1989 Page Two The attached ADDENDUM indicates North Fork's position that little, if any, additional cash park dedication be required for the lots located west of Andrie Street and north of 153rd Avenue NW and covered by Paragraph 5 of the original Park Dedication Agreement. In support of this position North Fork would cite the following facts: The Northfork PUD consists of approximately 1250 acres on which there are approvals to build 250 homes, thus creating a density of .25 units per acre. The anticipated population of the Northfork PUD, when completed, should be approximately 1000 people. o Under the current City Code the City can claim up to 10% of the land being platted for park dedication purposes or 10% of the fair market value of the undeveloped land as cash alternative. Presumably under the proposed new Park Dedication Ordinance this figure would be reduced to 7%. The first phase of the Northfork PUD consists of approximately 125 acres for which cash payments for park dedication have been and are continuing to be made. Of the remaining 1125 acres of the Northfork PUD 550 acres are already being set aside for private and/or public recreational use in the form of a proposed open to the public golf course (160 acres), private open space to be dedicated to the Northfork Homeowners Association (250 acres), the open waters of Lake Itasca and Northfork Lake and the surrcunding shorelines to be dedicated to theNorthfork Homeowners Association ~150 acres). North Fork, pursuant to the Declarations governing the entire PUD, pays to the Northfork Homeowners Association, out of the proceeds of the sale of each lot $250 to be used ~o-d~velop private amenities in the PUD. The City has received or will receive approximately 55 acres of park and trail under the terms of the existing Park Dedication Agreement and the proposed ADDENDUM, plus two acres for tot lots. This 57 acres represents 10% of all the land in the Northfork PUD not already being proposed for public and/or private use or included in the first phase. (See items 3 and 4 above). Contributions by the Northfork Homeowners Association and North Fork for the develomen% of amenities in the PUD reduces the City's obligation in such regard.
