NORTHFORK PUD ADDENDUM TO PARK DEDICATION AGREEMENT ADDENDUM to Park Dedication Agreement, hereinafter "ADDENDUMi', made this day of , 1989, by and between North Fork, Inc., hereinafter "Developer"; and the City of Ramsey, Anoka County, State of Minnesota, hereinafter "City". 1. WHEREAS, City and Developer have entered into a certain Park Dedication Agreement, hereinafter "Agreement", dated February 19, 1987, and attached hereto as Exhibit A; and 2. WHEREAS, Article 6 of such Agreement reserved the determination of Park Dedication requirements for that portion of the Northfork PUD located southerly of 153rd Avenue NW, hereinafter "future, Phase~'; 'and 3. WHEREAS, the future phase consists of approximately 137 acres; and 4. WHEREAS, the City Code generally permits the City to require 10% of the acreage of any plat to be dedicated for park purposes; and 5. WHEREAS, the City has indicated its desire to take park dedciation for the future phase in land: and 6[' WHEREAS, since the execution of the Agreement the City has identified certain specific public park use needs which can best be satisfied by the dedication of land located in areas of the Northfork PUD other than the future phase and Developer is willing to dedicate such alternative land as partial satisfaction of park dedication for the future phase; and 7. WHEREAS, Developer intends to cause an open to the public golf course to be developed in the Northfork PUD and to convey to the Northfork Homeowners Assoc|ation, on or before completion of the development, approximately 400 acres of land and water a private recreational open space; and 8. WHEREAS, the Northfork Homeowners Association intends to create parks, trails and other private amenities on the open space; and 9. WHEREAS, Developer, to facilitate development of such parks, trails and other private amenities, contributes $250.00-to the Homeowners Association out of the proceeds of each lot sale: and Io3
