NORTHFORK PUD <br /> <br />ADDENDUM TO PARK DEDICATION AGREEMENT <br /> <br /> ADDENDUM to Park Dedication Agreement, hereinafter "ADDENDUMi', made this <br /> <br />day of , 1989, by and between North Fork, Inc., hereinafter "Developer"; <br /> <br />and the City of Ramsey, Anoka County, State of Minnesota, hereinafter "City". <br /> <br /> 1. WHEREAS, City and Developer have entered into a certain Park Dedication Agreement, <br />hereinafter "Agreement", dated February 19, 1987, and attached hereto as Exhibit A; and <br /> <br /> 2. WHEREAS, Article 6 of such Agreement reserved the determination of Park Dedication <br />requirements for that portion of the Northfork PUD located southerly of 153rd Avenue NW, <br />hereinafter "future, Phase~'; 'and <br /> <br />3. WHEREAS, the future phase consists of approximately 137 acres; and <br /> <br /> 4. WHEREAS, the City Code generally permits the City to require 10% of the acreage <br />of any plat to be dedicated for park purposes; and <br /> <br /> 5. WHEREAS, the City has indicated its desire to take park dedciation for the <br />future phase in land: and <br /> <br /> 6[' WHEREAS, since the execution of the Agreement the City has identified certain <br />specific public park use needs which can best be satisfied by the dedication of land <br />located in areas of the Northfork PUD other than the future phase and Developer is willing <br />to dedicate such alternative land as partial satisfaction of park dedication for the <br />future phase; and <br /> <br /> 7. WHEREAS, Developer intends to cause an open to the public golf course to be <br />developed in the Northfork PUD and to convey to the Northfork Homeowners Assoc|ation, <br />on or before completion of the development, approximately 400 acres of land and water a <br />private recreational open space; and <br /> <br /> 8. WHEREAS, the Northfork Homeowners Association intends to create parks, trails <br />and other private amenities on the open space; and <br /> <br />9. WHEREAS, Developer, to facilitate development of such parks, trails and other <br />private amenities, contributes $250.00-to the Homeowners Association out of the proceeds <br />of each lot sale: and <br /> <br />Io3 <br /> <br /> <br />
