10. WHEREAS, Developer wishes to offset the commitments and contributions indicated <br />in Paragraphs 7, 8 and 9 above against cash park dedication requirements indicated in <br />Paragraph 5 of the Agreement; and <br /> <br /> Il. WHEREAS, the parties wish to determine to the fullest extent possible the <br />park dedication requirements for all of the Northfork PUD and to otherwise amend the <br />Agreement to reflect their current understandings; and <br /> <br /> 12. WHEREAS, a map showing the approx;mate locations of the various parcels of <br />the Northfork PUD encumbered by this ADDENDUM and the Agreement is attached hereto as <br />Exhibit B. <br /> <br /> NOW, THEREFORE, in consideration of the execution of the Agreement and of the mutual <br />covenants contained herein, the parties hereto agree as follows: <br /> <br /> 13. Developer, prior to the recording of the plat of the future phase, shall convey <br />to the City by Warranty Deed, a perpetual easement to the following propert~ located within <br />the future phase and/or the Northfork PUD: <br /> <br />a. A 35.00 foot wide permanent easement for trail purposes over, under and across <br /> the property as generally shown on Exhibit B and mo~e particularly described as: <br /> <br />-2- <br /> <br /> <br />
