CASE #13: <br /> <br />REVIEW CONSTRUCTION DEBRIS CONTAINMENT ORDINANCE <br /> By:. Glyn H. Huff, B,,ilcllng Official <br /> <br />Background: <br /> <br />Construction sites are for the most part relatively clear of debris within the City of Ramsey. <br />However, there have been construction sites that have not had the commitment of the builders to <br />keep their "work" areas clean and free of debris. In some cases, contractors dig holes to bury <br />debris. This practice of "casual dumping'' may interfere with future development of the lot and <br />also may cause harm to the surface water. Refer to Ramsey City Code 110.18 and 110.182: <br /> <br />110.18 DUMPING OF GARBAGE AND REFUSE <br /> <br />110.181 ACTS FORBIDDEN <br /> <br />No person, corporation, partnership, joint venture, association or other form of business <br />association shall leave, place, throw or deposit, or cause or permit any other person to leave, <br />place, throw or deposit in or upon any street or public place, or in or upon any vacant or <br />private lot or premises, any ashes, rubbish, garbage, refuse or other like or similar <br />substance or materials. <br /> <br />110.182 ACTS PERMITTED <br /> <br />The owner, or one acting with the owner's written permission, of any private property may <br />fill in or deposit upon property owned by him, ashes or other substances which are free from <br />dead animals or vegetable matter and other unwholesome or putrid substances or <br />materials, if such person has first secured in writing the permission of the City Clerk to do <br />so. The City Clerk shall freely grant such permission, except where it appears by all <br />evidence that such acts will be a nuisance or in some manner be a threat to the health or <br />safety of the City. The City Council in all cases may direct the City Clerk to grant such <br />permission. <br /> <br />This may be inadequate, considering what staff would like to address. In addition to the above <br />background statements, the construction debris containment ordinance should help to prevent <br />construction material (subject to being blown by the wind) being deposited on neighboring <br />properties. For your information, the following item is enclosed: <br /> <br />A. Draft Construction Debris Containment Ordinance <br /> <br />Observations: <br /> <br />While a number of contractors take it upon themselves to use a "dumpster" or bin for deposit of <br />construction debris, there are other contractors who do not seem to be responsible for their job site <br />clean-up. <br /> <br />Recommendation: <br /> <br />Staff recommends that the Planning and Zoning Commission advise City Council to adopt the <br />Construction Debris Containment Ordinance. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney X <br />City Engineer <br />Community Development Director X <br /> <br />Chief of Police <br />City Council __X <br />Planning & Zoning Commission X_. <br />Building Official X <br /> <br />IlL, <br /> <br /> <br />
