CASE #5: <br /> <br />REQUEST FOR CONDITIONAL USE PERMIT TO EXPAND RAMSEY AUTO; <br />CASE OF ROBERT & LOUIS WOJCIK <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />On May 2, 1989, the Planning and Zoning Commission conducted a public hearing regarding the <br />Wojcik request to expand Ramsey Auto Sales. During the case discussion, it was noted that the <br />applicants are in violation of their existing conditional use permit and the case was tabled pending <br />subnfission of a site plan addressing the entire site as proposed. <br /> <br />On May 5, 1989, the Planning Assistant issued a letter to the Wojciks's suggesting that they hire a <br />professional landscape architect to prepare a site plan and in the interim, bring their existing facility <br />~nto compliance. Shortly thereafter, the Planning Assistant was contacted by the firm hired to <br />prepare the Ramsey Auto site plan to discuss deadlines for submitting information to meet with <br />agenda preparation timelines. That finn could not meet the deadline for the June meeting and the <br />case was then planned for the July Planning and Zoning meeting. <br /> <br />On July 18, 1989, the Planning and Zoning Commission reviewed the site plan and tabled action <br />until the following is provided: <br /> <br />A report from City Staff regarding the status of compliance with the current <br />conditional use permit. <br /> <br />b) <br /> <br />A recommendation from the City Attorney regarding suggested wording for a <br />conditional use permit term that would require the applicants to provide financial <br />security to be used in mitigating the cost of enforcing the conditional use permit. <br /> <br />c) <br /> <br />Correction of deficient items on the site plan (septic system location, alternate septic <br />system location and indication of number of employees at the site). <br /> <br />d) Certified lot survey. <br /> <br />Community Development Technician Steve Lutmer inspected the subject property on July 25, 1989 <br />for compliance with the existing conditional use permit. His comments were submitted to Ms. <br />Frolik and her report is enclosed. City Attorney Goodrich has determined that the City does not <br />have the authority to require financial security for conditional use permit enforcement activities. <br />Mr. Goodrich's memo is also enclosed. Copies of the corrected site plan indicating septic system <br />locations and number of employees will be available at the meeting on August 1. A reduced <br />version of the certified lot survey is enclosed. <br /> <br />Observations: <br /> <br />The site plan indicates that the 3 parcels involved v,,ill accommodate a total of 126 display vehicles <br />and 14 customer/employee parking spaces. The site plan indicates improvements that will <br />eliminate the bituminous encroachment onto the Cty. Rd. #56 right-of-way. The site plan also <br />indicates removal of the easterly access onto Hwy. #10; this is in accordance with the current <br />conditional use permit. In addition, the site plan proposes to make improvements to what would <br />be the center and western most driveways from the 3 parcels onto Hwy. #10. The City Engineer <br />has recommended that the center driveway not be improved since the parcels can be served by the <br />westerly driveway. The site plan proposes B6 type curbing and the City Engineer is <br />recommending type B612. <br /> <br /> <br />
