DATE: July 26, 1989 <br /> <br />TO: Ramsey Planning and Zoning Commission <br /> <br />FROM: City Attorney William Goodrich <br /> <br />RE: Requiring financial security for conditional use permit enforcement activities <br /> <br />It is my opinion that financial securitx, for conditional use permit enforcement activities cannot be <br />required as a condition of a conditiofial use permit. First, this is not a requirement of our present <br />ordinance regulating conditional use permits. Most importantly, I do not believe that we have the <br />authority to require such a fee system, even if we were to amend the ordinance. The reason I have <br />some reservations on such a requirement is that it occurs to me to be very difficult to be specific <br />with respect to the amount that should be escrowed. I think this would have to be. looked at as too <br />vague of a requirement. Conditional use permits are a different situation than we have with <br />developers where the engineer gives an estimate of fees which may be required in the future and/or <br />the escrow has a specific time in the future when it can be released. <br /> <br />WKG:sf <br /> <br /> <br />
