o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />PROPOSED FINDINGS OF FACT <br />RAMSEY AUTO SALES <br />7205 HWY. gl0 N.W. <br />as of 7/27/89 <br /> <br />That Mr. Robert Wojcik and Mr. Louis Wojcik, hereinafter referred to as <br />"Applicants", have properly applied for a conditional use permit to expand a vehicle <br />sales operation in the I-1 Industrial District. <br /> <br />That the Applicants appeared before the Ramsey Planning and Zoning Commission <br />for a public hearing pursuant to Section 170.013D of the Ramsey City Code on <br />May 2, 1989, and that said public hearings were properly advertised and that the <br />minutes of said public hearing are hereby incorporated by reference. <br /> <br />That the subject property is legally described as follows: <br /> <br />That part of Lot 7, Auditor's Subdivision Number 34, of Anoka County Minnesota <br />described as follows: Commencing at the Southeast comer of said Lot 7 a distance <br />of 770 feet; thence North and parallel with the East line of said Lot 7 and to the <br />Northerly line of said Lot 7; thence Southerly on said Northerly line a distance of <br />350 feet to the point of beginning of the land to be described; thence South and <br />parallel with the East line of said Lot 7 and to the Southwesterly line of said Lot 7; <br />thence Southeasterly on said Southwesterly line a distance of 180 feet; thence North <br />and parallel with the East line of said Lot 7 and to the Northeasterly line of said Lot <br />7; thence Northwesterly on said Northeasterly line and to the point of beginning. <br /> <br />That the subject property is located in the I-1 Industrial District and is approximately <br />1.5 acres in size. <br /> <br />That vehicle sales is not a permitted use in the I-1 Industrial District. <br /> <br />That the adjacent property to the north is vacant and zoned I~1 Industrial; the <br />adjacent property to the west is zoned B-1 Business and developed with a pet clinic. <br /> <br />That there are other similar permitted uses in the CID,. <br /> <br />That on April 26, 1985, Mr. Allan E. Johnson received a conditional use permit to <br />develop the subject property, as a vehicle sales lot. Failure to develop the vehicles <br />sales lot within 12 months caused revocation of the conditional use permit. <br /> <br />That on June 16, 1988, the Planning and Zoning Commission recommended denial <br />of the request for a conditional use permit to utilize the property on which Ramsey <br />Auto Sales is currently located (PIN 28~32-25-44-0003 and #28-32-25-44-0004) <br />for vehicle sales because of traffic conditions in the area. <br /> <br />That on July 26, 1988, the Ramsey City Council issued a conditional use permit for <br />a vehicle sales operation on PIN #28-32-25-44-0003 and #28-32-25-44-0004. <br /> <br />That on September 27, 1988, City Council 'ruled that the access to the subject <br />vehicle sales lot from County Road #56 shall remain in it's current location versus <br />relocating to within the proposed future frontage road area. <br /> <br />That the Applicants are proposing to expand the vehicle sales operation onto the <br />adjacent parcel, PIN ~#28-32-25-44-0002. <br /> <br /> <br />
