City's park dedication requirements. City Attorney Goodrich stated that the phrase "Ten percent <br />(10%) or fair market value" raises a lot of problems. Mayor Reimann stated he felt that the <br />City should charge a certain fixed figure for park dedication. Commissioner Hendriksen stated <br />that if the City goes with a flat fee they may lose money. Councilmember Peterson stated that if <br />the City loses in one area they will make up in another. Mayor Reimann suggested accepting a <br />flat fee for park dedication instead of the "Ten percent (10%) or fair market value". The <br />majority of everyone present was in agreement with the Mayor. City Attorney Goodrich <br />suggested that this subject be resolved by the City Council. The general consensus of those in <br />attendance agreed with the City Attorney's suggestion. <br /> <br />On June 13, 1989, the Ramsey City Council reviewed a draft park dedication ordinance. The <br />City's Consultant, Merland Otto, presented a number of issues to the City Council. The first <br />issue was whether the land dedication should be further reduced from seven percent (7%) to <br />five percent (5%) if four in forty zoning is implemented. The City Council consensus was that <br />land dedication should remain at seven percent (7%) with no credit given upon future <br />resubdivision because park dedication is based on density. Mr. Otto noted that P.U.D.'s are <br />exempt from park dedication requirements as long as a minimum of Twenty percent (20%) of <br />the land is available for private open space or recreational use. The City Council consensus was <br />that P.U.D.'s should participate in the public park system and directed staff to redraft the P.U.D. <br />ordinance accordingly. Council also determined that park dedication requirements should be <br />fulfilled at the time of final plat approval. In addition the Council consensus was that <br />subdividers would be required to make basic park improvements with no credit given unless the <br />subdivider constructed a segment of a multi-use trail system. The subdividers would not be <br />required to construct any portion of the Mississippi Trail Corridor as it is intended to be a <br />County owned and operated system. Mr. Otto stated that the draft park dedication purposes that <br />park dedication resubdivision of lots within the MUSA would be Five Hundred Dollars <br />($500.00) per dwelling unit rather than the Ten percent (10%) of fair market value of the <br />new lot being created. Council agreed with requiring Five Hundred Dollars ($500.00) per <br />dwelling unit for resubdivision of lots in the MUSA area. <br /> <br />On June 27, 1989, the Ramsey City Council introduced the Park and Open Space dedication <br />ordinance. <br /> <br />Recommendations: <br /> <br />Staff recommends adoption of the amended Chapter 170.06 of the City Code: Park and Open <br />Space Dedication. <br /> <br />Council Action: <br /> <br />Motion to adopt Section 1. Amendment. Chapter 170.06 of the City Code: Park and Open Space <br />Dedication. <br /> <br /> <br />
