CASE ~7: <br /> <br />REQUEST FOR CONDITIONAL USE. PERMIT TO EXPAND <br />RAMSEY AUTO SALES; CASE OF ROBERT & LOUIS WOJCIK <br />By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />On May 2, 1989, the Planning and Zoning Commission conducted a public hearing regarding the <br />Wojcik request to expand Ramsey Auto Sales. During the case discussion, it was noted that the <br />applicants are in violation of their existing conditional use permit and the case was tabled pending <br />submission of a site plan addressing the entire site as proposed. <br /> <br />On May 5, 1989, the Planning Assistant issued a letter to the Wojciks's suggesting that they hire a <br />professional landscape architect to prepare a site plan and in the interim, bring their existing facility <br />into compliance. <br /> <br />On July 18, 1989, the Planning and Zoning Commission reviewed the site plan and tabled action <br />until the following is provided: <br /> <br />a) <br /> <br />A report from City Staff regarding the status of compliance with the current <br />conditional use permit. <br /> <br />b) <br /> <br />A recommendation from the City Attorney regarding suggested wording for a <br />conditional use permit term that would require the applicants to provide financial <br />security to be used in mitigating the cost of enforcing the conditional use permit. <br /> <br />c) <br /> <br />Correction of deficient items on the site plan (septic system location, alternate septic <br />system location and indication of number of employees at the site). <br /> <br />d) Certified lot survey. <br /> <br />Community Development Technician Steve Lutmer inspected the subject property on July 25, 1989 <br />for compliance with the existing conditional use permit. His comments were submitted to Ms. <br />Frolik and her report is enclosed. That report indicates that there were 3 vehicles encroaching on <br />the proposed expansion lot; those vehicles were removed by August 1. City Attorney Goodrich <br />has determined that the City does not have the authofi~, to require financial security for conditional <br />use permit enforcement activities. Mr. Goodrich's memo is also enclosed. The site plan was <br />corrected to indicate location of existing and alternate septic system locations and number of <br />employees on the site. A reduced version of the certified lot survey is enclosed. <br /> <br />The Planning and Zoning Commission met on August 1 to review the request and expressed a <br />great deal of concern with the history of violations of the existing conditional use permit, the past <br />tendency of this operation to accumulate inoperable vehicles and already serious traffic conditions <br />in the area which are aggravated by the public parking in road right-of-ways to look at auto <br />inventor3, during off-business hours. It was noted that the CiD' should consider requesting that the <br />County and State post 'no paring' signs along Cty. Rd. #56 at the Hwy. #10 intersection and all <br />along the Hwy. #10 corridor. The Planning and Zoning Commission recommended denial of <br />Robert and Louis Wojcik's request for a conditional use permit to expand Ramsey Auto Sales. <br />The Commission has also requested that if the City Council chooses to approve the request to <br />expand Ramsey Auto Sales, that the Planning and Zoning Commission be directed to review and <br />provide input to the proposed conditional use permit a~eement. <br /> <br /> <br />
