IMPLEMENTATION OF "4 IN 40 ZONING" <br /> By: Merland Otto <br /> <br />CASE <br /> <br />Background: <br /> <br />As a condition of Metropolitan Council's (MC's) approval to expand <br />the MUSA, the City is required to implement "4 in 40" acre zoning. <br />The city Council by Resolution #89-06-128 indicated to MC its <br />intent to implement "4 in 40" zoning. <br /> <br />As you may recall, the current zoning density policy for the rural <br />area is one dwelling unit per 10 acres based on the gross acreage <br />of the rural area with a minimum lot size of 2.5 acres. This <br />policy has allowed 2.5 lots to develop throughout much of the City. <br /> <br />A cut off date of January 1, 1990 has been established such that <br />preliminary plats and PUD's which have City Council approval prior <br />to January 1 can develop under the current density policy. After <br />January 1, the "4 in 40" policy will be in effect until such time <br />that MC revises its policy. <br /> <br />Under the proposed ordinance revision and amendment, we have <br />divided the City into five development districts. Lot Size - 4/40 Density <br />Rural Transition Area - 2.5 Acre Min. Lot Size - <br />4/40 Density <br />Rural Service Area - 10 Acre Min. Lot Size - 4/40 <br />Density <br />Mississippi Critical Rivers Area - 5A Min.
