Ramsey's opportunity for state or federal funds for airport improvements, <br />City Staff recommends the inclusion of Item 434 in the proposed conditional <br />use permit. Item ~34 indicates that the City can impose a surcharge on <br />landfill activities in the event they cause a delay or denial of state or <br />federal funds. <br /> <br />Mr. Otter stated that WMMI has agreed to performance goals but not to a <br />surcharge for causing a delay in receipt of funds for the airport project. <br />Mr. Otter noted that this clause places WMMI in the position of potentially <br />paying landfill surcharges for airport improvements delayed or denied <br />because of Site P, if it is selected. <br /> <br />Council saw a problem in determining the cause for delay or denial of state <br />and federal funds. <br /> <br />Motion by Counciimember Sorteberg and seconded by Councilmember Bawden to <br />delete Item 434 pertaining to Landfill Surcharge from the proposed <br />conditional use permit. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca, Pearson and Bawden. Voting No: None. <br /> <br />Mr. Otter referred to Item #33.b of the proposed conditional use permit <br />entitled 'Payment In Lieu Of Taxes' and stated that WMMI agrees to pay <br />commercial taxes on the ski hill operation but disagrees with paying taxes <br />equivalent to that of platted, vacant Industrial property on that portion <br />of the property not used by the ski hill facility. <br /> <br />Council noted that WMMI is being taxed up front with the landfill tipping <br />fee; the intent of paragraph 33.b is addressed in the city's <br />recommendations for legislation regarding hosting communities. <br /> <br />Motion by Councilmember Bawden and seconded by Councilmember Pearson to <br />revise Item $33ob in the proposed conditional use permit to read as <br />follows: 'Ski Hill Taxes. Property taxes on the Ski Hill Facility shall <br />be assessed at the rate of a commercial business operation.' <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca, Pearson and Bawden. Voting No: None. <br /> <br />Edward Moersfelder, attorney for WMMI requested that Item ~17 (Airspace <br />Review) of the proposed conditional use permit be amended to clarify that <br />WMMI will cooperate with FAA directives but not be under the jurisdiction <br />of FAA. <br /> <br />Council consensus was that Item #17 of the proposed conditional use permit <br />should read as follows: 'Airspace Review. WMMI shall submit a notice of <br />proposed construction to the Federal Aviation Administration (FAA) and <br />shall comply with reasonable applicable limitations, restrictions, <br />obstruction lighting, or operational controls to assure that the landfill <br />operations minimize hazards to air navigation.' <br /> <br />Council recessed at 10:00 p.m. <br /> City Council/November 15, i988 <br /> <br />Page 8 of 15 <br /> <br /> <br />
