Voting No: None. <br /> <br />~ Request For Minor Subdivisions' Cas, Of Mr. John Gobernatz: <br /> <br />Mr. Raatikka stated that Mr. Gobernatz is requesting a minor subdivision of <br />a 2.5 acre and a 37.5 acre lot south of 177th Avenue. Planning and Zoning <br />expressed concerns with the legallity of 177th as a public road; City <br />records indicate that it is owned by the City. The City has maintained the <br />road for at least 16 years; it is not up to City standards; upgrading <br />should be accomplished under petition or Chapter 429. <br /> <br />Mr. Goodrich stated that he believes the roadway is in the County's title <br />even though the auditor shows that the City has ownership; he will follow <br />up on that issue. <br /> <br />Council amended the proposed resolution as follows: <br /> <br />Add an item indicating that the developer shall provide for park <br />dedication requirements in accordance with. current park dedication <br />ordinance. <br /> <br />~d an item indicating that the developer shall provide an additional <br />27 feet of right-of-way adjacent to Hwy. ~47 for future upgrading. <br /> <br />Add an item indicating that the developer will enter into a <br />development agreement with the City. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Bawden to <br />adopt Resolution ~88-221 approving Mr. John Gobernatz' request for a minor <br />subdivision. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca, Pearson and Bawden. Voting No: None. <br /> <br />Review Sketch Plan Of Cedar Hills With Respect To Road <br /> Access: <br /> <br />Mr. Otto stated that the proposed plat of Cedar Hills consists of <br />approximately 136 single family lots. In addition, there are two other <br />proposed subdivisions in the area that consist of another 94 lots <br />appro~:imately. Residents of Hunter's Hill, Ramsey Terrace and Flintwood <br />Hills are concerned with the plats as the traffic from ail three areas <br />would exit via: 144th Avenue to the west; 142nd through Wimdemere Estates <br />to Dysprosium and south to Cry. Rd. ~116; extension of Magnesium Street to <br />Cty. Rd. #116. Planning and Zoning tabled preliminary plat of Cedar Hills <br />and requested that City Council declare it's imtent for working with the <br />developer to acquire an access route from the southwest pertion of Cedar <br />Hills to Cry. Rd. #116. City Staff is of the opinion that another access <br />is needed but it is a developer responsibility. <br /> <br />Mr. Goodrich advised Council to use it's right to condemn property <br />sparingly even though the right has been used to develop an MSA road in the <br />past. <br /> City Council/November 15, 1988 <br /> <br />Page 14 of 15 <br /> <br /> <br />
