Motion by Commissioner Deemer and seconded by Commissioner Bawden that Item #~o of the proposed findings of fact indicate that the proposed use will not be consistent with the intent of the zoning chapter. Motion by Commissioner Bawden and seconded by Commissioner Hendriksen to add Item #24 to the proposed findings of fact to indicate that the City has issued conditional use permit for private dog kennels for as many as 10 dogs. Motion carried. Voting Yes: Chairman Zimmem~an, Commissioners Bawden, Deemer, LaDue, Hendriksen and Terry. Voting No: None. Absent: Commissioner Shumway. Motion by Commissioner Deemer and seconded bv Commissioner Terry to recommend that City Council adopt the proposed findings of fact, as amended. Motion carried. Motion by Commissioner Bawden and seconded by Commissioner Deemer to recommend that City Council approve Mr. Bret Scott's request for a conditional use permit for a commercial dog kennel. Further Discussion: Commissioner Deemer noted that the application indicates someone other than Mr. Scott is the fee owner of the subject property. Mr. Scott stated that he is purchasing the property on a contract for deed. Ms. Frolik noted that a conditional use permit is gamed to the proper[}, versus the property owner; ceasing the use for a pe:dod of 12 months voids the conditional use permit. Amendment by Commissioner Deemer and seconded by Commissioner Hendriksen to revise Item '~" ~._-~ of the proposed conditional use permit to read as follows: 'No dog shall be permitted to be left outside while no one is home.' Amendment carried. Voting Yes: Chairman Zimmerman, Commissioners Bawden, Deemer, La_Due, Hendriksen and Terry. Voting No: None. Absent: Commissioner Shumway. Motion carried.
