Coumdssioner inquired if ~edication of park la~d applied in ~his case. <br /> <br />Mr. Dom replied that with a PUD, if 20% or more of the land is used for <br />public purposes no park land dedication is necessary. <br /> <br />Co~u~ssioner Schneider inquired if the money obtainea from the sale of park <br />land would be ~eposited in the City Park Fund. <br /> <br />Mr. Schnelle replied that it would be. <br /> <br />Motion by Commissioner Schneidar to recommend preliminary approval of Mr. Bill <br />Dorn's proposed planned unit development based on the findings of fact <br />and the recommendations of City ~ngineer, City Staff and Planning and Zoning <br />Commission. <br /> <br />Co~nissioner Deemer secon6ed the motion for further discussion. <br /> <br />~k~rther Discussion: Commissioner Deemer stated that the motion should include <br />wording to the effect that the sale of .the City property'shall not be for an <br />amount less than that to be the determined worth of the property at the time <br />of it's donation to the City as park l~nd. <br /> <br />Commissioner Schneider amended her motion to included that wording. <br /> <br />Co~,m,issioner Deemer seconded the amendment to the motion. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners K~nnen, Zimmerman, <br />Deemer, Schneider, Isakson and LaDue. Voting No: None. <br /> <br />Case ~3: Proposed Critical Area And Wetlands Ordinance: <br /> <br />f~airman Peterson noted that a Variance Procedure should be added to the <br />Ordinance.and in the case of Mr. M~rtin, if present conditions continue to <br />exist the Planning and Zoning Commission goes on record as recommending that <br />Mr. Martin be allowed furture subdivision into two lots. <br /> <br />Commissioner Schneider inquired if Mr. Martin felt secure in that his concerns <br />were answered by the Planning Commission. <br /> <br />Mr. ¥~rtin replied that he accepts P&Z's interpretation of the ordinance. <br /> <br />Ccmu~issioner Schneider recommended that 'Mr. Martin review 'of the minutes of <br />this meeting and that he also approach City Council' with his concerns. <br /> <br />Mr. Schnelle noted that Mr. Martin's written presentation sut~nitted at this <br />meeting will be included in the Council agenda. <br /> <br />Commissioner Schneider stated appreciates Mr. 'Martin's feasible problems <br />regarding a tract of land along 139th but considering ~. Fm=--tin does own <br />additional adjacent acreage, at this point she does not want to go on record <br />as being in favor of granting Mr. Martin a variance for future subdivision. <br />Commissioner Schneider stated that she is in favor of variance procedure <br />being included in the ordinance. <br /> <br />Mr. Schnelle stated that Mr. M~rtin should be able to have no more than two, <br />but at least two lots from that tract of land. <br /> <br />P&Z/August 2, 1983 <br /> Page 4 of'8 <br /> <br /> <br />
