Chairman Peterson polled the Commission regarding how many lots they feel Mr. Martin should be entitled to develop from that pa/~cicular tract of land. Conu~issioner LaDue - two lots Commissioner Isakson -.. two lots Commissioner Deemer - Stated that Mr. Martin has a case for more than one lot and in the not too far future sewer may be available to this property and w~ n~[ght be looking at 240' frontage lots. Cou=~issioner Zim~erm~n - two lots. P&Z should be looking at the entire ordinance as it relates to the entire property. Commissioner Kennen - two lots Chairm~n Pe~erson - agreed with Commissioner Schneider's earlier commants regarding this issue. The majority consensus of the Planning and Zoning Commission is that two lots would be appropriate at the time the property is platted. Commissioner Deemer inquired if the wording on Page 2 of the ordinance should be clean cutting or clear cutting. Mr. BergJ'replied that it was a typographical error and it should be clear cutting and also noted that a variance procedure will be added to the ordinance. Motion by Couu~issioner Z~mmerman and seconded by Commissioner Deemer to table recommending approval of this ordinance until the next regular meeting of P&Z for the purpose of further review. Motion carried. Voting Yes: Chairman Peterson, Commissioners Kannen, Deemer, Zimmerman, Isakson, LaDue and Schneider. Voting No: None. Case 04: Amending Of C~apter 110.14 Entitled "Weeds" Of the City Code: Chairman Peterson stated that Council has requested P&Z to review and make recommendations regarding Chapter 110.14 entitled "Weeds". Chairm~n Peterson stated that one section of the chapter, 110.143 - Growing Grass, is causing problems. If a citizen does not comply with this code, notices are sent to that citizen that he is in violation of having grass taller than 12" and that he has 10 days to correct'the situation. If the citizen tmokes no action, the City ~an contract a weed cutter to cut it and the cost would be .assessed to the property owner. Mrs. Steiner - 6121 158th Trane - Own a vacant lot adjacent to our home on which there are trees, sumac and wildflowers and have been requested by neightxDr$ not to clear this lot because it is a beautiful piece of untouched nature and a relief from the monotony of ~anicured lawns. Terry Pettro - 6140 157th - Stated that he received a letter frc~ the City that he is in violation and to clear cut the property. Have Surveyed homes of Council persons and they are all in violation and hav~ surveyed a couple of home of P&Z commission m~mhers and they too are in violation. Stated that he has planted 1500-2000 seedlings on his property-and it would ~e difficult to cut .the e~]l grass, etc. without killing all the seedlings. Mr. Pettro submitted the following as his recommended wording for this section of the · ordinance: - 110. 143 Growing Grass - Ail parcels of land within the platted portions of the City with a dwelling on it must have a m~nimu~ of ~000 square feet of cut grass adjacent to such P&Z/August 2, 1983 Page 5 of 8
