MEMO <br /> <br />September 1, 1989 <br /> <br />Because the County has delayed acquiring my land for a park <br />and considering the 4 in 40 zoning change as of January 1, <br />1989, I must begin the platting process in order to preserve <br />my development rights. <br /> <br />The driveway identified as 139th Lane is not a public right <br />of way, but a non-exclusive driveway esement in favor of the <br />owner of tract "B," RLS ~53. It results from the contract- <br />for-deed sale of Tract "B" in the early 1960's and it pre- <br />dates the Critical Area ordinance. <br /> <br />It is my intent to plat lots with river frontage and land on <br />both sides of the driveway as shown on the accompanying plat. <br />The fee title of the driveway would be conveyed to the buyers <br />of the lots. It is also my intent that these two lots should <br />be slightly larger than 2.5 acres each because of this. <br /> <br />Oames M. Martin <br /> <br /> <br />
