Banwart, Community Development Director <br /> <br />Background: <br /> <br />On April 11, 1989, the City of Ramsey received application for Gordon's Gardens 2nd Addition. <br />The proposed subdivision consists of one block, consisting of four (4) lots. This subdivision is <br />being considered as a minor subdivision. The total acreage is 26.24 acres. The existing land use <br />is Rural Residential/Agricultural use. The future land use is anticipated to remain the same. The <br />proposed subdivision is a re-subdivision of Lot 2, Block 1, Gordon's Gardens Addition. Harley Gordon stated that in <br />his discussions with Anoka County Department of Transportation the3, indicated that the upgrading <br />of an existing access from Count), Road ~22 for the proposed Lots 1 and 2 was acceptable. <br />However, they had reservations about allowing an additional driveway access from County Road <br />#22 to Lot 3. Rather, Anoka County would prefer the extension of 180th Avenue Northwest to <br />gain access to Lot 4, Block 1. Anoka Count5, has also stated that if access cannot be obtained from <br />180th Avenue Northwest to Lot 4, Block 1, they would consider an additional driveway access <br />from County Road #22. <br /> <br />On May 2, 1989, the Ramsey Planning and Zoning Commission requested the City Attorney to <br />determine the feasibility and cost responsibility of condemnation to extend 180th Avenue <br />Northwest and then to obtain City Council direction on same. The City Attorney advises that <br />eminent domain is most likely acceptable and the public purpose requirements can be met by <br />showing the necessity of the road in allowing for the best and highest use of the land. <br />Furthermore, the City Attorney's opinion is the costs incurred for the eminent domain procedure <br />should be borne by the benefitting developer. According to Mr. Harley Gordon, the asking price <br />for the segment of land needed to extend 180th Avenue Northwest was stated to be six thousand <br />dollars ($6,000.00). The cost of eminent domain could likely approach that amount. However, <br />the negotiated purchase of the needed land considering vacation of a portion of the existing cul-de- <br />sac could be substantially less. <br /> <br />On Ma), 11, 1989, the Ramsey Park and Recreation Commission recommended the acceptance of <br />cash to satisfy the park dedication since no parks or trails are proposed for this area. <br /> <br />$$ <br /> <br /> <br />
