furnace and an), increase in furnace capacity or addition of furnaces will
require the application and approval of a new or mended CUP.

Motion ca,ed. Voting Yes: Chai:-man Zimmerman, Commissioners Terry, Shumwav and
LaDue. Voting No: None. Absent: Commissioners Holm and Hendriksen.

Case #£: Review Of Comprehensive Park Dedicalion Agreemenl Of
Entire Norlhfork P.U.D.:

Mr. Banwart reported that there have been meetings to review the comprehensive park
dedication agreement for the entire Nonhfork P.U.D. and fix:re is a total consensus thai the
land dedication portion satisfies park dedication requirements. With regards to the cash
requirements, current ordinance requires $500.00 per dwelling unit or 10% of the fair
market value, whichever is greater. North Fork is requesting that the park dedication
agreement be amgnded to require a cash park dedication of $250.00 per dwelling uni~ wesl
of Andrie Street in lieu of open space amenities provided with the development of
Northfork. Staff is recommending approval of a cash dedication of $250/dwellin~2 unit
west of Andrie Street. The Parl~ and Recreation Commission does not endorse reoucing
thc cash dedication aspect of the park dedication a~eement as the amenities in Nonhfork
will not totally address the recreational needs of the projected population of Nonhfork.

Mr. Dennis Peck was presem representing North Fork, Inc. and requesting that the Ciw
address what, if an3', credit No/qhfork is eligible for in lieu of providing another gol~f
course in Ramsey. In addition, North Fork, Inc. contributes $250 per lot sold to the
homeowners association to be used for internal improvements to unused areas. IX'~r. Peck
noted thru there will be a total of 550 acres of open space in Northfork. Mr. Peck also
noted that North Fork, Inc. will be challenging Staffs interpretation of fair market value
used in determining that a $2,000 cash dedication is due for Northfork 4th Addition,
consisting of one lot.

Commlssioner Shumway a~eed with the findings of the Park and Recreation Con'm'fission
and recommended retaining the cash park dedication requirements at $500/dwelling unit
west of And.de Street. At the time Northfork 4th Addition was platted, time was of the
essence for North Fork, Inc. and they were aware of the cash park dedication requirement
that would be placed on that plat.

Ix4r. Peck noted that the Development A~eement for Nonhfork 4th Addition left the park
dedication issue open for discussion.

Mr. Otto noted that the park dedication ordinance is being reviewed and it will be
recornmend~ that the credh section be deleted because it is cumbersome to administer.

Commissioner Terry recalled that at the time Northfork 4th was platted, there was
discussion regarding what to base the fair market value on -- the selling price or the raw
land value.

Motion by Commissioner Shumway and seconded by Commissioner Terry to recommznd
that the Comprehensive Park Dedication A~eement for Northfork P.U.D. require
$500/dwelling unit to satisfy the cash park dedication requirements for properties west of
And.fie Street.

Planning & Zoning Commission/April 18, 1989
Page 3 of 4
