Councilmember Del.uca stated that his major concern is diseased trees and Mr. Gorecki's <br />compliance with the Diseased Tree Ordinance should be monitored; other than that, Mr. <br />Gorecki's business seems to be appropriate in the Industrial District. <br /> <br />Councilmember Cich stated that he is also concerned with the spread of tree diseases but in <br />tile future, cases like this should probably be brought to Council for a point of clahfication. <br /> <br />Mr. I-lartley noted that the discussion thus far indicates that there needs to be definitions for <br />the various permitted uses in the Industrial District; the proper approach would be to have <br />the Planning and Zoning Commission review some proposed definitions. In addition, tile <br />City Council is indicating that the type of business Mr. Gorecki conducts would be <br />classified a supply yard. Mr. Hartley also noted that classifying Mr. Gorecki% operation <br />as a supply yard is precedent setting. <br /> <br />Councilmember Peterson stated that spe',~king as the former chairman, it was the intent of <br />the Commission to write a zoning ordinance based on performance smnd,qrds versus listing <br />all the permitted uses and their definitions; the Planning and Zoning Commission should be <br />directed to continue that effort and establish a more workable zoning ordinance that is easier <br />to interpret. <br /> <br />Motion by Councilmember Cich and seconded by Councihnember Pearson to direct City <br />Staff to withdraw the complaint against 1~. Steve Gorecki of Outside Services, Inc. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Pererson. Voting No: None. <br /> <br />Council consensus was that City Staff should not try to further interpret the zoning <br />ordinance based on tonight's discussion but rather discuss with the Planning and Zoning <br />Commission the need to establish performance standards for the entire City and generats <br />some needed definitions. <br /> <br />Council recessed at 9:07 p.m. <br /> <br />Mayor Reimann called the special City Council meeting back to order at 9:27 p.m. <br /> <br />Case ~3: Nudity Ordinance Consideration: <br /> <br />Police Chief Auspos was present and stated that Jimmy B's is conducting a striptease type <br />of entertainment that was investigated by the County and found not to be J.n violation of <br />State statute. However, the State statute does not apply specifically to striptease <br />entertainment. <br /> <br />Councilmember Peterson stated that there is no guarantee that other establishments <br />choosing to offer striptease entertainment will choose the same guidelines for themselves as <br />Jimmy B's has and recommended that the City Council consider adopting a nudity <br />ordinance to establish parameters in the event other establishments provide this type of <br />entertainment. <br /> <br />Ci~' Council/November 14, 1989 <br /> Page 10 of 14 <br /> <br /> <br />
