until such time as an agreement between the City and Applicant may identify credit for land <br />dedication or recreational amenities to be constructed by the Applicant; and <br /> <br /> WHEREAS, on August 12, 2003, the City Council reviewed and approved the <br />Preliminary Plat; and <br /> <br /> WHEREAS, on August 27, 2003, the City received a final plat submittal from the <br />Applicant; and <br /> <br />WHEREAS, on September 23, 2003, the City Council reviewed the Final Plat; and <br /> <br /> WHEREAS, the City and Applicant are negotiating the terms of the City's required <br />Performance Contract (Development Agreement); and <br /> <br /> WHEREAS, the Subject Property needs to be rezoned by the City in order to <br />accommodate those land uses contemplated by Applicant. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />Final Plat approval for RAMSEY TOWN CENTER ADDITION is granted to the <br />Applicant, contingent upon the following: <br /> <br />a) Compliance with City Staff Review Letter dated September 16, 2003, Revised <br /> September 19, 2003 <br />b) Compliance with Engineering Department's Review Letter dated September 16, <br /> 2003 <br />c) Hakanson Anderson Review Letter dated September 16, 2003 <br />d) Bolton and Menk Review Letter dated September 16, 2003 <br />e) Adoption by the City of a zoning ordinance rezoning the Subject Property to allow <br /> the residential/commercial uses contemplated by Applicant. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Elvig, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Cook <br />Councilmember Elvig <br />Councilmember Pearson <br />Councilmember Strommen <br />Councilmember Zimmerman <br /> <br />RESOLUTION #03-09-263 <br /> Page 2 of 3 <br /> <br /> <br />
