until such time as an agreement between the City and Applicant may identify credit for land dedication or recreational amenities to be constructed by the Applicant; and WHEREAS, on August 12, 2003, the City Council reviewed and approved the Preliminary Plat; and WHEREAS, on August 27, 2003, the City received a final plat submittal from the Applicant; and WHEREAS, on September 23, 2003, the City Council reviewed the Final Plat; and WHEREAS, the City and Applicant are negotiating the terms of the City's required Performance Contract (Development Agreement); and WHEREAS, the Subject Property needs to be rezoned by the City in order to accommodate those land uses contemplated by Applicant. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) Final Plat approval for RAMSEY TOWN CENTER ADDITION is granted to the Applicant, contingent upon the following: a) Compliance with City Staff Review Letter dated September 16, 2003, Revised September 19, 2003 b) Compliance with Engineering Department's Review Letter dated September 16, 2003 c) Hakanson Anderson Review Letter dated September 16, 2003 d) Bolton and Menk Review Letter dated September 16, 2003 e) Adoption by the City of a zoning ordinance rezoning the Subject Property to allow the residential/commercial uses contemplated by Applicant.
