Case #6: <br /> <br />Request Council Direction Regarding Possible Condemnation Of' <br />Land Adjacent To The Proposed Gordon's Gardens 2nd Addition: <br /> <br />Mr. Banwart stated that Mr. Gordon is proposing to develop Gordon's Gardens 2nd Addition. <br />The Anoka Count.,,' Department of Transportation has reviewed the sketch plan and indicated that <br />up~ading an existing driveway onto Count>' Road ,t'22 to serx, e Lots 1 and 2 is acceptable. The <br />Count,,', Ci.,x' Staff and the Planning ant! Zoning Commission would prefer the extension of 180th <br />Avenue N.~~. versus allowing an additional driveway onto Ct3'. Rd. #22 to access Lot 4. Mr. <br />Gordon has indicated that the property owner is willing to sell the easement for an extension of <br />180th Avenue at a substantial price. On May 2, the Planninp and Zoning Commission requested <br />that the City Staff determine the feasibility and cost responsibility for condemnation. Tile City <br />Attorney has determined that condemnation is within the realm of City efforts: cost of <br />condemnation would be the responsibility of tile subdivider; and in this case, the cost of <br />condemnation could approach that of the asking price. 1.'. is recommended thc: City Council direc: <br />City Staff to assist in a negotiated purchase of the easement necessau' for th.'. extension .:,f 180;,. <br />Avenue N.W. If that effort fails, Mr. Gordon can determine if he wishes to proceed by rcquestin~ <br />condemnation of the easement. <br /> <br />Councilmember DeLuca noted that it might also be of benefit to have Mr. Gordon dedicate <br />easements to the south boundary of Gordon's Gardens 2nd Addition that could eventually provide <br />a connection to Ermine Blvd. N.W., should it become necessary in the future. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Peterson to direct City Staff <br />to proceed with the negotiated purchase of necessa~, lands for the exmnsion of 180th Avenue <br />N.W. and to pro:ced in the event of successful purchase, the vacation of portions of the cul-de- <br />sac, which would be come unnecessaD, in the event of the extension of 180th Avenue N.W. <br />Furthermore, the subdix4der would assume financial responsibility for the negotiated purchase and <br />would also be financially responsible for the res;oration of the cul-de-sac prior to vacation to those <br />benefitting prope~,' owners residing outside of the proposed subdivision as part of the <br />Development A~eement for Gordo's Gardens 2nd Addition. <br /> <br />Further Discussion: Mr. Gordon stated that he is agreeable to providing easements for the <br />continued extansion of 180th Avenue to the south. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich and <br />?eterson. Voting No: None. <br /> <br />Case #7: Amended Development Permit For Custom Coach RV, Inc.: <br /> <br />Mr. Banwart stated that on March 14, the City ~anted site plan approval to Custom Coach to <br />remode.1 and add onto an existing building located at 6845 Hwy. -fi:10 N.W., fom~erly the <br />McGregor's Truck Stop. On April 5, the City was advised by Custom Coach that certain soils had <br />been contaminated by perrolium products leaking from under~ound storage tanks and lines prior <br />to the time they acquired the site. On May 10, Custom Coach indicated that they w~ted to proce~ <br />whh the addition and remodeling to the building but desired some relief from the site plan time <br />schedule in consideration of the fact that the site, at a later date. may require excavation because of <br />tine contaminated soils.
