pertinent to the relocation of the street at the time it is upgraded. It appears by the feasibility <br />study that there are going to be some additional costs relative to the movement of the street <br />from it's present site into the easement which should not be assessed against the property <br />owners. Mr. Hinton is also concerned that once the road is relocated, that the portion of <br />his property that was being travelled au a roadway would be restored and seeded. <br /> <br />Mayor Reimann directed City Staff to have the City Attorney review the agreement referred <br />to and if the costs relating to the relocation of the road are to be deleted from assessable <br />project costs, the affected property owners are to be notified of the modified estimated total <br />and per unit project costs. <br /> <br />Bret Scott - 7910 173rd - Stated that he originally signed the petition for the proposed <br />improvements to Bison Street but he now is opposed to the project. Mr. Scott stated that <br />one of the reasons he is opposed to the upgrading of Bison Street is that the realignment <br />will move the road onto his property. Mr. Scott stated that his driveway accesses onto <br />173rd, not Bison Street, and it is not worth $5000.00 to him to have it paved. Mr. Scott <br />also noted that City Council recently granted him a conditional use permit for a commercial <br />dog kennel; now the Council is approving the proposed subdivision of Dellwood Hills <br />which includes 9 residential lots; the 9 additional homes in the area increases the chances <br />that there will be complaints about his kennel operation and his permit will be revoked. <br />Mr. Scott stated that the issue of paving of Bison is the result of the proposed Dellwood <br />Hills Addition; all 9 lots in Dellwood Hills, versus the two lots that abut Bison, should be <br />assessed for paving Bison. Mr. Scott stated that the project should have included paving <br />Bison Street in it's entirety rather than stopping the pavement at 171 st. <br /> <br />Mayor Reimann agreed that the project should have considered surfacing t71st in it's <br />entirety, thereby adding 3 more units to the proposed assessment roils and reducing the <br />overall per unit assessment. <br /> <br />Mr. Raatikka noted that according to City policy, if Mr. Scott does not have access to <br />Bison Street, he should receive a 1/2 unit assessment. <br /> <br />Mayor Reimann noted that there is an easement in place for the correct alignment of Bison <br />Sn-eet and relocating the road into that easement is not a taking of Mr. Scott's property. <br /> <br />John Anderley - 16917 Bison Street - Inquired as to why Bison Street is being considered <br />for upgrading at this time and why didn't the project include the entirety of Bison. <br /> <br />Mr. Raatikka explained that the City received a petition for a feasibility study to upgrade <br />Bison from 171st to Bison Sn'eet. The petition was submitted by Dellwood Construction. <br /> <br />John Anderley - Stated that with the existing homes and the proposed 4 in 40 zoning, the <br />maximum number of homes there can be on Bison is 7 or 8; the proposed upgrading of <br />Bison is to accommodate the proposed Dellwood Hills which consists of 9 lots; Dellwood <br />should be responsible for 50%-60%, even 100%, of the cost to upgrade Bison. Inquired if <br />the road will be realigned into it's correct position even if the road is not upgraded. <br /> <br />Mayor Reimann explained that City Council reviewed the proposed plat of Dellwood Hills <br />and was concerned with a plat accessing onto an unimproved road; on that basis, Dellwood <br />Construction initiated a petition to upgrade Bison Street. Mayor Reimann also stated that <br />he strongly believes that all those who benefit from an improvement should share in the <br /> <br />City Council Public Hearing/August 29, 1989 <br /> Page 2 of 3 <br /> <br /> <br />
