Since at that time it was my under- <br />standing that we were accepting applications for Off-sale licenses with the <br />proviso that the method of selection of competeLug applicants was not yet de- <br />cided, I accepted this one and later advised Mr. Kern that an investigative fee <br />was required. Because the building was not ready for occupancy there was no <br />need for the actual license fee to be paid. As of this date I have not begun <br />any investigative actions of any significance . <br /> The recently passed resolution states in #3 of the first set of criteria <br />that no applicant shall apply if that applicant is disqualified by any of the pro- <br />visions of the city ordinance~ etc. The AO00 square foot criteria does auto- <br />matically disqualify Mr. Kern insofar as h$$current applicati:n is concerned <br />since he is proposing only 2~75 square feet. Mr. Kern is now aware of this <br />and is withdrawing his application per my phone conversation ~dth him. <br /> He would like to have his investigation fee refunded, i told hLm that the <br />ordinance states that no investigation fee shall be refunded however I would <br />bring his re.cuest before the council for a~cision as to ~ether or not it <br />can be done under these circumstances. <br /> <br /> <br />
