INTOXICATING LIQUOR FOR ON-SALE AN ORDINANCE LICENSING AND REGULATING THE SALE AND CONSUMPTION OF "ON-SALE" INTOXICATING LIQUOR, REPEALING INCONSISTENT ORDINANCES, AND PROVIDING A PENALTY FOR VIOLATION. The Council of the City of Ramsey ordains: PROVISIONS OF STATE LAW ADOPTED The provisions of Minnesota Statutes Chapter 340A relating to the definition of terms not defined herein, licensing, consumption, sales, financial responsibility of licensees, hours of sale, and all other matters pertaining to the retail sale, distribution, and consumption of intoxicating liquor, are adopted and made a part of this ordinance as if set out in full. REQUIRED LICENSE 1. No person, except 3o wholesalers or manufacturers to the extent authorized under state license, shall directly or indirectly deal in, sell, or keep for sale any intoxicating liquor for "on sale" sale without first having received a license to do so as provided in this section. "On sale" licenses shall be issued only to: a) hotels; b) restaurants; c) bowling centers; d) exclusive liquor stores; e) clubs or congressionally chartered veterans organizations provided that the organization has been in existence for at least three years and liquor sales will only be to members and bona fide guests. Special on sale licenses for the sale of intoxicating liquor on Sunday shall be issued only to hotels and restaur,~n*~s~ an~c.~ as defined in this chapter. All sales of liquor by such establishments shall be in accordance with M.S.A. 340A.504, Subd. 3. Temporary on sale license. The City may issue a temporary on sale license to a club or charitable, religious, or other non-profit organization in existence for at least three years for the on sale of intoxicating liquor in connection with a social event within the City. Such a license shall be for a period not exceeding three consecutive days. The license may authorize on sale on premises other than premises the licensee owns or permanently occupies. The license may provide that the licensee may contract for intoxiating liquor catering services with the holder of a full-year on sale intoxicating liquor license issued by the City. The fee for said license shall be as established by City Council resolution, pursuant to City Code Section 130. Licenses issued under this section are subject to all laws,. City code, and ordinances governing the sale of intoxicating liquor except the insurance requirements of this chapter and those laws and ordinances which by their nature are not applicable. DEFINITIONS The following terms have the meanings ascribed to them in this section. 1. ~coh.olic beverage. "Alcoholic beverage" is any beverage containing more than one-half of one percent alcohol by volume. 2. _Bowling center. "Bowling center" is a business constructed as and used for the primary purpose of bowling, and which business establishment actually contains bowling alleys, pinsetters, and all other equipment necessary for bowling activity. A business shall not be considered a "bowling center" where the only type of bowling available is through the use of coin operated amusement devices. 3. Club. "Club" is an incorporated organization organized under the laws of the state for civic, fraternal, social, or business purposes, for intellectual improvement, or for the promotion of sports, or a congressionally chartered veterans' organization, which: a) has more than fifty (50) members; b) has owned or rented a building or space in a building for more than one (1) year that is suitable and adequate for the
