19. <br /> <br />20. <br /> <br />for sale, alcoholic beverages in any original <br />package which has been refilled or partly <br />refilled. No licensee shall directly or <br />through any other person dilute or in any <br />manner tamper with the contents of any <br />original package so as to change its <br />composition or alcoholic content while in the <br />criginal package. Possession on the <br />premises by the licensee of any alcoholic <br />beverage in the origina! package differin~ m <br />the composition or alcoholic conlent in the <br />liquor when received from the manufacturer <br />or wholesaler from whom it was purchased <br />shall be prima facie evidence that the <br />contents of the original package has been <br />diluted, changed or tampered with. <br />No sale of alcoholic beverage shall be made <br />to or in guest rooms of hotels, unless the <br />rules of such holels provide for the service <br />of food in guest rooms; nor unless the sale of <br />such alcoholic beverage is made in the <br />m&nner 'on sale" are required to be ma~de; <br />nor unless such sale accompanies and is <br />incident to the regular service of meals to <br />guests therein; nor unless the rules of such <br />hotel and the description, location and <br />number of such guest rooms are fully set out <br />in the application for a license. <br />No transfer of a license shall be permitted <br />from place to place or person Io person <br />without complying with the requirements of <br />an original application, except as provided <br />by Section 130.058(8) and each transfer <br />shall require the approval of the City Council <br />and the Liquor Control Commissioner. <br /> <br />FINANCIAL RESPONSIBILITY AND <br />INSURANCE <br />Compliance with financial responsibility <br />requirements of State law and of this ordinance is <br />a continuing condition of any license granted <br />pursuant to this ordinance. <br /> <br />HOURS OF OPERATION <br />1. No sale of intoxicating liquor for <br /> consumption on the licensed premises may be <br /> made: <br /> a) belween 1:00 a.m. and 8:00 a.m. on the <br /> days of Tuesday through Saturday; <br /> b) between 12:00 midnight and 8:00 a.m. on <br /> Mondays; <br /> <br />c) ¢,fmr 1:00 a.m. on Sundays, excep; as <br />provided by subdivision 3; <br />d) between 8:00 p.m. on December 24 and <br /> 8:00 a.m. on December 25, except as <br /> provided by subdivision 3. <br />Special Sunday 'on sale" licuor licenses. <br />Hotels, restaurants, clubs, and bowling <br />centers {as. per State ,~w]'- '~ havi2cv <br />Sunday 'on sale" liouor licenses may serve <br />alcoholic beverages in con~unction wht~e <br />sale of food between the hours of 10:O0 <br /> <br />provided the licensee is ic comorm~nce w,,.. <br />the Minnesota Cle~n Air Ac~, <br />notwithstanding the provisions of <br />Paragraph 1 above. <br />Except as o~ne~ise herein provided, ali ~on <br />sale" establishments, bottle clubs and <br />public drinkin9 places sh~ll be c!osed ~o ~he <br />public not I~ter than one-half (1/2) hour <br />after the required time for stopping sales, <br />until the time herein provided as <br />permissible for sales, consumption or <br />display. No persons oiher than employees <br />shall be permitted within such <br />establishments during the closed periods. <br />All such "on sale" licensees may keep <br />licensed premises open at times when the <br />sale of intoxicating and non-alcoholic <br />~verage is prohibited for sale of food or <br />recreational activity, provided such <br />licensees shall lock, or in other manner <br />secure, all f~cilities or equipment for the <br />sevin9 of such liquor sta~ing not later th~n <br />1:00 ~.m. until the time hefein provided as <br />permissible for sales, consumption or <br />display. All public entrances 1o premises <br />o~n ~fler 1:00 &.m. sh~ll remain open <br />unlocked during ~11 times when said <br />premises have customers therein.
