The City shall bill the cost of such removal to <br />W~I, and payment shall be remitted within 30 days of the date <br />of such billing. Visual checks for litter and debris <br />accumulation shall be made at least once daily by employees <br />of WM/~I. <br /> <br />Waste Tire Processinq Equipment. Ail equipment and vehicles <br />utilized at the Waste Tire Processing Facility shall be <br />periodically inspected and maintained to minimize noise, <br />safety and fire safety concerns. <br /> <br />Water Qualitv. Surface and ground waters originating outside <br />and passing through or adjacent to the tire processing site <br />and runoff water discharged from the site shall, at its point <br />of departure from the Parcel of Record, meet all applicable <br />federal and state water quality standards as they exist from <br />time to time during the period of this CUP. The operator <br />shall perform any water treatment necessary to comply with <br />applicable state and federal waterlquality standards as they <br />exist from time to time during the period of this CUP. <br /> <br />Screeninq. W/~MI agrees to screen the tire processing facility <br />from any recreational use which may occur on the Parcel of <br />Record while the tire processing facility is operational. <br />WI~MI shall submit a screening plan to the City Engiheer for <br />approval prior to continuing waste tire processing operations <br />in the event of an overlap of recreational use and tire <br />processing. Such screening shall be achieved using grading, <br />landscape elements, and plant materials which will achieve up <br />to 90% opacity. Supplemental screening on the north and east <br />sides of the site may be ordered by the City to comply with <br />the then current screening requirements for outside storage <br />on industrial property. ~ <br /> <br />Closure Due to CUP Revocation, Other Circumstances. In the <br />event this CUP is revoked or WM/~I closes operation of the <br />waste tire operation for any reason, including but without <br />limitation, order of the court or other agency of competent <br />jurisdiction, bankruptcy, insolvency, or abandonment, W/~MI <br />shall immediately proceed to remove waste tires, rims and <br />other material according to the closure plan approved by the <br />MPCA and which shall comply with all requirements of the MPCA <br />and Anoka County relating to final closure. In the event <br />fails to comply with the terms of this CUP, the City may, upon <br />30 days' written notice to h~I enter into the property and <br />perform all such obligations, the costs of which shall be <br />borne by WMMI or, in default thereof, by its surety. <br /> <br /> <br />
