CASE # 6

INTRODUCE OFF-SALE LIQUOR ORDINANCE
AND REVIEW RESOLUTION #88-241
By: Mike Auspos, Chief of Police

Background:

The first issue simply involves the introduction of the revision of our off-sale liquor license
which also includes private club and on-sale wine licenses.

The second issue deals with Resolution #88-24I dealing with the development of criteria for
the issuance of an additional off-sale liquor license. At the Council meeting of December 27,
1989 the draft criteria were discussed by the Council and it was decided to eliminate item #2,
amend item #4, and to add another criteria. The resolution was then passed.

In order to properly evaluate the two applications received, I am requesting that the resolution
be reviewed by the present City Council to determine if the intent of criteria Item #1 is to limit
the area to the 1990 Urban Area (now MUSA line-2000) or the line designated on the zoning
map as "Urban Area".

Enclosed for your information are Resolution #88-241, City Council meeting minutes dated
December 27, 1988, and the draft off-sale liquor ordinance.

Recommendation:

Council Action:

Motion to:
introduce Ordinance #89-
liquor.

licensing and regulating the sale of off-sale intoxicating

Review Checklist:

City Administrator
City Attorney
City Engineer
Community Development Director

Chief of Police
Finance Officer
Public Works Superintendent
Other

.X,
